THE COMMISSIONER OF INCOME T vs. BARCLAYS INVESTMENTS AND LOA
What did the High Court hold?
The High Court held that there was no error in the order passed by the Tribunal. The Court considered the short issue of whether the assessee followed the test laid down by the Supreme Court in CIT Vs. Woodward Governor India (P.) Ltd. The judgment notes that the CIT(A) found that the assessee had fulfilled all conditions for deductibility of market-to-market losses, and the Tribunal, being satisfied with the CIT(A)'s findings, dismissed the Revenue's appeal. Consequently, the High Court dismissed the Tax Case Appeals, answering the substantial questions of law against the Revenue. The operative direction was the dismissal of the appeals.
What were the facts?
The Revenue has filed these appeals against the common order dated 13.07.2016 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'D' Bench, Chennai. The appeals pertain to assessment years 2008-09 and 2009-10. The dispute concerns the allowability of anticipated loss claimed by the assessee, M/s. Barclays Investments and Loans (India) Ltd., on account of Equity Linked Debentures as a business loss. The Commissioner of Income Tax (Appeals) had found that the assessee fulfilled the conditions for deductibility of market-to-market losses. The ITAT upheld the CIT(A)'s order, leading to the present appeals by the Revenue.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that anticipated loss claimed on account of Equity Linked Debentures is allowable as a business loss when market-to-market losses are not an ascertained liability which could be set off against taxable income? 2. Is not the finding of the Tribunal bad, especially when market-to-market loss is a mere provision created in the balance sheet and does not constitute an ascertained liability which is contingent in nature and therefore not an allowable deduction? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that market-to-market losses are not ascertained liabilities, but mere provisions created in the balance sheet, contingent in nature, and therefore not allowable as a deduction. They questioned the Tribunal's finding that such losses are allowable as a business loss.
