What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue on the grounds of low tax effect, citing Circular No.17/2019 of the CBDT which increased the monetary limit for pursuing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in these cases was below this threshold. Consequently, the substantial questions of law were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No costs were imposed. The connected Civil Miscellaneous Petition (CMP) was also dismissed. The judgment did not decide the merits of the substantial questions of law.

What were the facts?

The Commissioner of Income Tax, Chennai (Revenue) filed two Tax Case Appeals (TCA.Nos.147 & 148 of 2021) before the High Court of Judicature at Madras against the common order dated 03.4.2017 passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. The appeals pertained to the assessment year 2012-13 and challenged the Tribunal's deletion of disallowances made under Section 54 of the Income Tax Act, 1961. The amount in dispute, specifically the unutilized amount of capital gains, was Rs.89,66,339/-. The appeals were filed under Section 260A of the Act.

What were the issues?

1. Whether the Tribunal was correct in deleting the disallowance made under Section 54(1), considering the assessee did not fulfill the conditions under Section 54(2) by depositing the unutilized amount in the capital gains account scheme on or before the due date for filing the return under Section 139(1)? (Question of law). 2. Whether the claim for deduction under Section 54 should be allowed even if the assessee failed to deposit the unutilized amount of Rs.89,66,339/- in the capital gains account scheme within the time stipulated under Section 139? (Question of mixed law and fact). Assessee's Contention: The judgment does not record any specific contentions made by the assessee. Revenue's Contention: The Revenue argued that the assessee had not fulfilled the conditions mandated under Section 54(2) for availing the deduction under Section 54(1), specifically regarding the timely deposit of the unutilized amount in the capital gains account scheme. The Revenue relied on the provisions of Section 54 and Section 139 of the Income Tax Act.

Which sections of the Income-tax Act were involved?

Section 54,Section 54(1),Section 54(2),Section 139,Section 139(1),Section 260A

The Revenue filed these appeals by raising the following substantial questions of law : “i. The learned Senior Standing Counsel for the appellant submits that the above appeals are not pursued by the Revenue on account of the low tax effect in terms of Circular No.17/2019 dated 08.8.2019 issued by the Central Board of Direct Taxes. By the said Circular, the monetary limit for filing or pursuing an appeal before the High Court has been increased to Rs.1 Crore. It is further submitted that the tax effect in the respective cases is less than the threshold limit. 5. In the light of the said submissions, the above tax case appeals are dismissed on account of the low tax effect. The substantial questions of law raised are left open. In the event the tax effect in the respective cases is above the threshold limit fixed in the said circular, liberty is granted to the Revenue to make a mention to this Court to restore the appeals to be heard and decided on merits. No costs. Consequently, the connected CMP is also dismissed.
