What did the High Court hold?

The appeal was dismissed by the High Court on account of low tax effect. The Revenue's Senior Standing Counsel submitted that the appeal was not being pursued due to the low tax effect, citing CBDT Circular No. 17/2019, which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. As the tax effect in this case was below this threshold, the appeal was dismissed. The substantial questions of law framed were left open. Liberty was granted to the Revenue to file a petition to restore the appeal if the tax effect was found to be above the threshold limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 28.10.2016 passed by the Income Tax Appellate Tribunal, Madras 'A' Bench. The appeal pertained to the assessment year 2011-12 and concerned the deletion of disallowances made under Section 36(1)(va) of the Act. The assessee is M/s. Prostar Hospitality Services Pvt Ltd. The dispute revolved around the belated payment of the employee's contribution towards Provident Fund and ESI. The Revenue challenged the Tribunal's decision to grant relief to the assessee on this account.

What were the issues?

The Tribunal was asked to decide the following substantial questions of law: 1. Whether the Tribunal was right in deleting the disallowance made under Section 36(1)(va) despite the delay in payment of Employees' Contribution to ESI and PF, which is not allowable as per the Act? 2. Is the Tribunal's finding bad by deleting additions made under Section 36(1)(va), which is allowable only if employee's contribution to Provident Fund and ESI are credited within the specified due dates as per respective Acts, which was not the case? 3. Whether, on the facts and circumstances, the Tribunal was right in granting relief to the assessee for belated payment of employee's contribution towards Provident Fund and ESI, especially when Section 2(24)(x) read with Section 36(1)(va) of the Income Tax Act was violated? The Revenue argued that the disallowance under Section 36(1)(va) should not have been deleted as the employee's contributions to PF and ESI were not paid within the stipulated due dates as per the respective Acts, violating the provisions of Section 2(24)(x) and Section 36(1)(va) of the Income Tax Act. The judgment does not record any specific arguments made by the assessee.

Which sections of the Income-tax Act were involved?
