What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the Revenue's submission that the tax effect was below the monetary limit stipulated in Circular No.3/2018 dated 11.07.2018, which sets the threshold for filing appeals before the High Court at Rs.50,00,000/-. The Court noted that Paragraphs 2 and 3 of the circular prescribe these monetary limits. While the appeals were dismissed on this procedural ground, the Court explicitly stated that the substantial question of law framed in the appeals was left open. The Revenue was granted liberty to seek restoration of the appeals if the tax effect was found to be above the specified limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The assessee, M/s.Technical Stampings Automotive Ltd. (now M/s.Sungwoo Gestamp Hitech Ltd), engaged in manufacturing sheet metal components, paid royalty to its Korean holding company, M/s.Sungwoo High Tech Company Limited, for technical know-how. The Assessing Officer treated this royalty payment as capital expenditure, rejecting the assessee's claim of it being revenue expenditure. The Commissioner of Income Tax (Appeals) and subsequently the Income Tax Appellate Tribunal (ITAT) ruled in favour of the assessee, holding the royalty as revenue expenditure. The Revenue, aggrieved by the ITAT's orders for assessment years 2002-03 and 2007-08, filed these appeals before the High Court.

What were the issues?
