THE COMMISSIONER OF INCOME T vs. M/S.NEYVELI LIGNITE CORPORA
What did the High Court hold?
The High Court did not decide the substantial questions of law. It noted that the Direct Tax Vivad Se Vishwas Act, 2020, was enacted to provide for the resolution of disputed tax. The learned counsel for the respondent/assessee submitted that the assessee had availed the Vivad Se Vishwas Scheme and had been issued Form-3 on March 9, 2021. Consequently, the High Court held that nothing further survived for adjudication in the appeal. The appeal was disposed of on this basis, with no costs awarded. The specific findings of the ITAT on the allowability of expenditure as current repairs or revenue expenditure, and the application of Section 80IA, were not reviewed or affirmed by the High Court.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order of the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, dated June 26, 2015. The appeal pertained to Assessment Year 2001-02 and concerned the assessee, M/s. Neyveli Lignite Corporation Ltd. The core dispute revolved around the allowability of expenditure incurred in revamping a urea plant. The High Court admitted the appeal on substantial questions of law. However, the proceedings were subsequently impacted by the enactment of the Direct Tax Vivad Se Vishwas Act, 2020.
What were the issues?
The High Court was to decide four substantial questions of law: 1. Whether the ITAT was justified in holding that the revamping of the urea plant constituted allowable expenditure as current repairs, despite being incurred after the plant's lifespan and not preserving existing machinery? 2. Whether the ITAT was correct in allowing the expenditure as revenue expenditure when the assessee had capitalized it in its books? 3. Whether the ITAT was justified in relying on the amendment to Section 80IA made by the Finance Act, 1999, for allowing 100% deduction, even though operations commenced in 1994-95 under different legal provisions? 4. Whether the ITAT's finding was flawed by applying amended provisions retrospectively, contrary to the principle of strict interpretation of machinery provisions? The Revenue contended that the expenditure was not current repairs and that capitalizing it in the books indicated its capital nature. The Revenue also argued against the retrospective application of amended provisions. The assessee's contentions are not explicitly recorded in the judgment, but their arguments before the ITAT would have supported the allowability of the expenditure and the application of the amended provisions.
