COMMISSIONER OF INCOME TAX vs. M/S.SOUTH INDIA SURGICAL COM
What did the High Court hold?
The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme, and orders were passed on December 23, 2020. In light of this subsequent development, the Court granted the assessee liberty to restore the appeal if the decision on their declaration under the scheme was not in their favour. The Court directed that if such a prayer is made, the Registry should entertain it without requiring a petition for condonation of delay and place it before the appropriate Division Bench. Consequently, the Tax Case Appeal was disposed of with this liberty, and the substantial questions of law were left open. No decision was made on the merits of the penalty levied under Section 271(1)(c).
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated July 29, 2019, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench. The appeal pertains to the assessment year 2015-16 and challenges the ITAT's decision regarding the levy of penalty under Section 271(1)(c) of the Act. The core of the dispute revolves around whether the Assessing Officer's disallowance of the assessee's claim constituted concealment of income warranting penalty, and if the ITAT was correct in holding that penalty could not be levied.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that penalty under Section 271(1)(c) cannot be levied on the assessee? 2. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that the Assessing Officer had merely not accepted the assessee's claim, leading to an opinion of concealed income, and consequently levied penalty without appreciating the assessee's deliberate and malafide intention to evade tax in light of false pleas and claims? Assessee's Contention: The learned counsel for the assessee submitted that the assessee had already filed a declaration/undertaking under the Vivad Se Vishwas Scheme, and orders were passed on December 23, 2020, in Form No. 3. Based on this subsequent event, the assessee sought liberty to restore the appeal if the ultimate decision on the declaration was not in their favour. Revenue's Contention: The judgment does not record any specific contentions made by the Revenue regarding the substantial questions of law raised in the appeal.
