What did the High Court hold?

The High Court did not decide the substantial questions of law on their merits. Instead, the Court noted the submission by the Revenue's counsel regarding CBDT Circular No. 17/2019, which mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue confirmed that the tax effect in these appeals was less than the stipulated threshold limit. Consequently, the Court dismissed the present appeals as withdrawn, explicitly stating that the substantial questions of law are kept open for determination in appropriate cases. No costs were awarded. The judgment does not record any finding on the merits of the disallowance under Section 40(a)(i) or the classification of software payments as royalty under Section 9(1)(vi).

What were the facts?

The appeals were filed by the Commissioner of Income Tax, Chennai (Revenue) against the common order dated 16.08.2011 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, concerning assessment years 2002-03, 2003-04, and 2004-05. The respondent assessee is M/s. Abaqus Engineering India Pvt Ltd. The appeals challenge the ITAT's decision to allow disallowance under Section 40(a)(i) on payments made to Abaqus Inc without deduction of tax at source, and whether such payments for licensed software constitute royalty under Section 9(1)(vi) of the Income Tax Act. During the proceedings, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals should not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was below this threshold.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Income Tax Appellate Tribunal was right in holding that the disallowance under Section 40(a)(i) on the amount paid to Abaqus Inc without deduction of tax at source is to be allowed? 2. Whether the assessee, who sold the licensed version of a software product developed by the parent company, could be treated as royalty payment made to a non-resident and covered under Section 9(1)(vi) of the Income Tax Act? Assessee's Contentions: The judgment does not record specific contentions made by the assessee. The assessee is identified as M/s. Abaqus Engineering India Pvt Ltd. (Now known as Dassault Systems P Ltd). Revenue's Contentions: The Revenue argued that the disallowance under Section 40(a)(i) on payments made to Abaqus Inc without deduction of tax at source should not have been allowed. The Revenue also contended that payments for the licensed version of software should be treated as royalty under Section 9(1)(vi) of the Income Tax Act. The Revenue later submitted that the tax effect in these appeals was less than the threshold limit stipulated in CBDT Circular No. 17/2019.
