What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue on account of low tax effect, citing CBDT Circular No.17/2019. The Court noted that the Revenue's learned Senior Standing Counsel submitted that the appeal was not being pursued due to the tax effect being less than the increased monetary limit for appeals before the High Court. Consequently, the substantial questions of law framed by the Revenue were left open. The Court granted liberty to the Revenue to file a petition to restore the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax, Corporate Circle-4(1), Chennai, filed an appeal before the High Court of Judicature at Madras against an order of the Income Tax Appellate Tribunal (ITAT), Madras 'C' Bench. The ITAT's order, dated 05.09.2018 in ITA.No.59/CHNY/2018, pertained to the assessment year 2014-15. The appeal challenged the ITAT's decision regarding the eligibility of a capital loss of Rs.2.02 crores incurred by the assessee, M/s. Megh Sakariya International P. Ltd., for deduction as a bad debt under Section 36(1)(ii) of the Income Tax Act, 1961. The Revenue also questioned the applicability of the Apex Court's decision in M/s. TRF Ltd. to the assessee's case.

What were the issues?

1. Whether, on the facts and in law, the ITAT was right in holding that a capital loss of Rs.2.02 crores incurred by the assessee during AY 2014-15 is eligible for deduction under Section 36(1)(ii) of the Income Tax Act and qualifies as a bad debt? 2. Whether, on the facts and in law, the ITAT was right and justified in holding that the decision of the Apex Court in M/s. TRF Ltd. is applicable to the assessee's case, given that the facts are entirely different and distinguishable? Assessee's Contentions: The judgment does not record any specific contentions made by the assessee before the High Court. Revenue's Contentions: The Revenue submitted that the appeal was not being pursued due to a low tax effect, as per CBDT Circular No.17/2019. The monetary limit for appeals before the High Court was increased to Rs.1 Crore by this circular, and the tax effect in this case was below that threshold.
