What did the High Court hold?

The High Court held that the franchise fees should be assessed as business income and not under the head income from house property. The Court noted that the issue had already been decided in the case of "Tamil Nadu Tourism Development Corporation Ltd., Vs. Deputy Commissioner of Income Tax" reported in (2014) 90 CCH 0087 ChenHC and (2014) 368 ITR 053 (Mad). Therefore, in view of the previous judgment, the appeals were liable to be dismissed. The substantial questions of law framed were answered against the appellant. The operative direction was that the appeals are dismissed.

What were the facts?

The assessee, Tamil Nadu Tourism Development Corporation Ltd., a wholly owned Government of Tamil Nadu undertaking, filed its return of income for Assessment Year 2007-08. The assessment was reopened under Section 147, and the Assessing Officer completed the assessment under Section 143(3) read with Section 147. The Assessing Officer assessed franchise fees of Rs.1,97,94,431/- as business income, disallowing the assessee's claim for it to be treated as income from house property and disallowing the statutory deduction under Section 24. The Commissioner of Income Tax (Appeals) confirmed this order, relying on a previous decision of the Madras High Court in the assessee's own case. The Income Tax Appellate Tribunal also confirmed the order of the CIT(A). The assessee has filed these appeals against the Tribunal's order.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the franchise fees should be assessed as business income and not under the head income from house property, considering that leasing of hotels and restaurants is distinct from operating them. 2. Whether the rental income from lease/franchise should be assessed as business income and not under the head income from house property, given that the assessee had ceased to carry on hotel business in the properties and had leased them out. 3. Whether income from leasing would constitute income from house property only if the assessee corporation had ceased to carry on its regular business of tourism development. The assessee argued that leasing of hotels and restaurants is distinct from operating them and that they had ceased to carry on hotel business in the impugned properties, choosing to exploit them as owners by leasing them out. The revenue contended that the issue had already been decided by the High Court in the assessee's own case.

Which sections of the Income-tax Act were involved?

Section 260A,Section 143(1),Section 147,Section 148,Section 143(3),Section 24
