What did the High Court hold?

The High Court noted that it was not necessary to decide the substantial questions of law due to subsequent developments. The Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020, for the resolution of disputed tax. The learned counsel for the assessee informed the Court that the assessee had been issued Form-3 under this Act and sought permission to withdraw the appeal. Consequently, the High Court dismissed the Tax Case Appeal as withdrawn. No costs were awarded. The miscellaneous petitions connected to the appeal were also closed.

What were the facts?

The assessee, M/s. Sri Vigneshwara Foundry, filed an appeal under Section 260A of the Income Tax Act, 1961, challenging an order dated 05.03.2015 passed by the Income Tax Appellate Tribunal (ITAT), Madras "C" Bench. The appeal pertained to Assessment Year 2010-11. The High Court admitted the appeal on substantial questions of law. Subsequently, the assessee informed the Court that they had opted for the Direct Tax Vivad Se Vishwas Act, 2020, and had been issued Form-3. Based on this development, the assessee sought permission to withdraw the appeal.

What were the issues?

The High Court was to decide the following substantial questions of law: 1. Whether the Assessing Officer's disallowance of payments, despite evidence from recipients admitting receipt, merely because some workmen denied receipt, was perverse? 2. Whether the invalidity of an agreement document was sufficient for the Assessing Officer to conclude non-payment, when other independent evidence existed to prove payment? 3. Whether the Tribunal erred in upholding orders based on witness evidence that was not subjected to cross-examination? The assessee argued that they had opted for the Direct Tax Vivad Se Vishwas Act, 2020, and sought to withdraw the appeal. The revenue was represented by Senior Standing Counsel and Standing Counsel.
