THE COMMISSIONER OF INCOME T vs. M/S.MRF LTD
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for pursuing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No decision was made on the merits of the substantial questions of law.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 13.5.2015 passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. The appeal pertains to assessment year 2009-10 and challenges the Tribunal's deletion of additions made by the Assessing Officer (AO) under the Fringe Benefit Tax (FBT). The dispute involves the applicability of Sections 115WB(1), 115WB(2), and 115WB(3) of the Act. The High Court admitted the appeal on substantial questions of law.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in deleting the additions made by the AO under Section 115WB(1) under the Fringe Benefit Tax? 2. Is not the finding of the Tribunal bad as it is against the Rule of consistency, especially when the decision for earlier assessment years 2006-07, 2007-08, and 2008-09 had been decided in favour of the department but the Tribunal deviated from the same in the present assessment year without any change in circumstances? 3. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the provisions of Sec.115WB(2) and 115WB(3) are not applicable, especially when the basis of taxation for Fringe Benefit has been clarified in Board Circular No.8 of 2005? Assessee's Contentions: Not recorded in the judgment. Revenue's Contentions: The Revenue argued that the Tribunal's finding was against the rule of consistency, deviating from earlier years' decisions without changed circumstances.
