What did the High Court hold?

The Revenue's counsel submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in this case was stated to be below this threshold. Consequently, the High Court dismissed the appeal on the grounds of low tax effect. The substantial questions of law were left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit.

What were the facts?

The Revenue, Commissioner of Income Tax, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 17.04.2015 passed by the Income Tax Appellate Tribunal (ITAT) 'A' Bench, Chennai. The appeal pertains to assessment year 2006-07 and challenges the ITAT's cancellation of a penalty levied under Section 271(1)(c) of the Act. The assessee is M/s.Craftsman Automation (P) Ltd. The appeal was admitted by the High Court on specific substantial questions of law.

What were the issues?

The Tribunal had to decide two substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in cancelling penalty levied under Section 271(1)(c) of the Income Tax Act, when the assessee furnished inaccurate particulars and claimed deduction under Section 80JJAA when the assessee is not eligible for the same? 2. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in law in cancelling penalty levied under Section 271(1)(c) when the Appellate Tribunal in its quantum order confirmed that the assessee is not eligible for deduction under Section 80JJAA of the Income Tax Act? The Revenue contended that the assessee furnished inaccurate particulars and claimed an ineligible deduction under Section 80JJAA, warranting the penalty. The Revenue also highlighted that the ITAT's quantum order confirmed the ineligibility for the deduction. The judgment does not record specific arguments from the assessee's side regarding these questions.
