COMMISSIONER OF INCOME TAX - vs. M/S. LIFE CELL INTERNATIONAL
What did the High Court hold?
The High Court did not decide the substantial questions of law. The Court noted that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted, and the assessee had availed the scheme, with Form-3 being issued by the Department. Given these subsequent developments, the Court found no useful purpose in keeping the appeals pending. The appeals were disposed of on the ground that the assessee had availed the Vivad Se Vishwas Scheme. The assessee was granted liberty to restore the appeals if the ultimate decision under the Act was not in their favour. The substantial questions of law were left undecided.
What were the facts?
The Commissioner of Income Tax – II (Revenue) filed three appeals (TCAs 1017 to 1019 of 2015) before the High Court of Judicature at Madras against the orders of the Income Tax Appellate Tribunal (ITAT) dated 08.04.2015. These appeals pertained to assessment years 2005-06, 2007-08, and 2009-10. The appeals challenged the ITAT's decision regarding the taxation of storage fees collected by M/s. Life Cell International P. Ltd. (assessee). During the pendency of these appeals, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee informed the court that they had availed the Vivad Se Vishwas Scheme, and the Department had issued Form-3 on 30.12.2020.
What were the issues?
The High Court was to decide two substantial questions of law: 1. Whether the Appellate Tribunal was correct in holding that storage fees collected by the assessee in a lump sum cannot be treated as income of the year of receipt, contrary to Section 5(1) of the Income Tax Act. 2. Whether the Tribunal was correct in holding that a lump sum fee collected for 21 years should be taxed on a pro rata basis when the assessee follows the mercantile system of accounting. The Revenue argued that storage fees collected in a lump sum should be taxed in the year of receipt, citing Section 5(1). The assessee contended that, following the mercantile system of accounting, the income should be taxed on a pro rata basis over the period it pertains to, even if collected upfront. The judgment does not explicitly record arguments from either side beyond the framing of the questions and the subsequent development.
