SHRI KHANDAL VIPRA SEWA SANTHAN TRUST ,JAIPUR vs. CIT(E), JAIPUR, JAIPUR
What did the Tribunal hold?
The Tribunal set aside the impugned order and restored the Assessee's application to the file of the learned CIT(E) for a fresh decision. The Tribunal noted two significant flaws in the CIT(E)'s order: first, the reliance on verification from a different entity with a different PAN and application date, and second, the contradictory recording of a reply to the show cause notice while stating no reply was furnished and then not discussing the reply. The Tribunal held that natural justice requires that submissions on record be considered. Regarding the section code, the Tribunal stated that the correct clause under section 12A(1)(ac) needs to be identified based on facts, and the proviso allowing condonation of delay should be considered. On the RPT Act, the Tribunal refrained from expressing a view on its necessity for charitable objects under section 12AB(1)(b)(i)(B), leaving it for the CIT(E) to decide. The Tribunal also noted that the CIT(E)'s remark on the admissibility of an appeal under the RPT Act was beyond its authority. On genuineness, the Tribunal found the queries detailed but noted the CIT(E) had not examined the trust deed's objects clause when holding the hostel activity outside section 2(15). The CIT(E) was directed to give the Assessee a reasonable opportunity of being heard and to call for necessary information. The Tribunal expressed no view on the merits of any issue. Ground No. 1 was allowed for statistical purposes. Ground No. 3 (costs) was dismissed.
What were the facts?
The Assessee, Shri Khandal Vipra Sewa Sansthan Trust, filed an application in Form No. 10AB on 30.09.2025 for registration under section 12AB of the Income Tax Act, 1961. The Commissioner of Income Tax (Exemptions), Jaipur (CIT(E)), rejected the application on 05.02.2026. The grounds for rejection were that the application used the wrong section code, the Assessee was not registered under the Rajasthan Public Trust Act, 1959, and the genuineness of its activities was not proved. The Assessee appealed this order to the Income Tax Appellate Tribunal (ITAT). The Assessee did not appear physically but filed written submissions. The Revenue's representative supported the CIT(E)'s order.
What were the issues?
1. Whether the learned CIT(E) erred in rejecting the Assessee's application for registration under section 12AB of the Act on the ground of using the wrong section code and claiming benefits under sections 10, 11, and 12 of the Act, contrary to section 12A(1)(ac)(vi) of the Act? 2. Whether the learned CIT(E) erred in rejecting the application on the ground that the Assessee is not registered under the Rajasthan Public Trust Act, 1959, which is a requirement under section 12AB(1)(b)(i)(B) of the Act? 3. Whether the learned CIT(E) erred in rejecting the application on the ground that the genuineness of the Assessee's activities was not proved, as per section 12AB(1)(b)(i) of the Act? Assessee's contentions (in written submissions): The learned CIT(E) rejected the application on technical grounds (section code, absence of RPT Act registration) and genuineness without fairly considering the Assessee's replies. The RPT Act registration is not a condition under the Income Tax Act. The Assessee prayed for the order to be set aside and for costs. Revenue's contentions: The learned Departmental Representative supported the CIT(E)'s order, stating the Assessee did not furnish the required details despite opportunities.
Which sections of the Income-tax Act were involved?
Section 12AB,Section 12A(1)(ac),Section 11,Section 12,Section 2(15),Section 253(1)(c),Section 29

PER : PRAKASH, ACCOUNTANT MEMBER:-
This appeal by the Assessee is directed against the order of the learned Commissioner of Income Tax (Exemptions), Jaipur [hereinafter referred to as “the learned CIT(E)”] dated 05.02.2026 passed under section 12AB(1)(b)(ii) of the Income Tax Act, 1961 (hereinafter referred to as “the Act”), rejecting the application of the Assessee in Form No. 10AB for registration under section 12AB of the Act.
The grounds of appeal raised by the Assessee before us in the memorandum of appeal in Form No. 36 read as under:
ITA No. 653/JPR/2026 Shri Khandal Vipra Sewa Sansthan Trust “Ground No. 1. The Learned CIT(E) has erred on facts and in law in rejecting the application filed by the assessee u/s 12A(1)(ac)(vi) in form 10AB seeking registration u/s 12AB of the IT act, 1961 on the ground that- i. application filed in form 10AB is wrong section code and taking benefit of section 10, 11, & 12 ii. Assessee is not registered under Rajasthan Public Trust Act, 1959 and iii. Genuineness of activities has not been proved. Ground No. 2. The Appellant craves to alter, amend and modify any ground of appeal. Ground No. 3. Necessary cost be awarded to the assessee.”
Briefly stated, the facts of the case are that the Assessee, a trust at Jaipur which, as recorded in the impugned order, runs a hostel for students, filed Form No. 10AB on 30.09.2025 under section code 4A. The learned CIT(E) treated it as an application under section 12A(1)(ac)(vi)(B) of the Act. A questionnaire dated 14.11.2025 and a show cause notice dated 20.01.2026 were issued. The application was rejected on the three grounds summarised below:
Issue Reason given by the learned CIT(E) Para Section code 2 The Assessee had claimed exemption under sections 11 and 12 of the Act in earlier years (returns for A.Y. 2023-24 to 2025-26), so it could not apply under section 12A(1)(ac)(vi)(B) of the Act; the application is not maintainable. 3 Rajasthan Public The Assessee is not registered under section 17 of Trust Act, 1959 the RPT Act, which is a requirement of another (“the RPT Act”) law material for achieving its objects under section 12AB(1)(b)(i)(B) of the Act. Genuineness 4 Receipts from students for the hostel show a commercial activity outside section 2(15) of the Act; details of the health camp, separate books for the hostel, salaries, profit on sale of agricultural land, fixed assets, expenses and donations were not furnished.
ITA No. 653/JPR/2026 Shri Khandal Vipra Sewa Sansthan Trust 4. None appeared for the Assessee. However, in the written submissions, the Assessee submitted that the learned CIT(E) rejected the application on a technical ground of section code, on the absence of registration under the RPT Act, which is not a condition under the Act, and on genuineness without fairly considering the replies filed. It was prayed that the impugned order be set aside and also pressed the prayer for costs.
The learned Departmental Representative (hereinafter referred to as “the learned DR”) supported the order of the learned CIT(E) and submitted that the Assessee did not furnish the details called for despite several opportunities.
We have heard both parties and perused the material on record. Two features of the impugned order call for notice at the outset. First, the finding in para 2.2 that “the applicant itself stated” that it had taken the benefit of sections 11 and 12 of the Act rests on a verification reproduced in para 2.1. Surprisingly, that verification is not the Assessee’s. It is made by a different person on behalf of a different entity located at Jodhpur, bearing a different PAN, and it refers to an application made on 09.03.2024, whereas the Assessee filed its application on 30.09.2025. Second, the table at the beginning of the annexure records against the show cause notice dated 20.01.2026 that a “Point wise reply has been furnished”, while the body of the order states more than once that no reply to that notice was furnished. The reply so recorded is not discussed anywhere in the order. Natural justice, often described as fair play in action, requires that what a party places on record is at least considered. A conclusion drawn from another entity’s declaration, with a reply on record left unexamined, cannot be sustained.
On the section code, the question is not merely which code the Assessee selected but which clause of section 12A(1)(ac) of the Act its case actually falls under. That depends on facts such as whether the Assessee held any earlier registration and whether, and on what basis, exemption under sections 11 and 12 of the Act was claimed in the returns for the earlier years. These facts have to be verified from the record. Once the appropriate clause is identified, the learned CIT(E) will also
ITA No. 653/JPR/2026 Shri Khandal Vipra Sewa Sansthan Trust have to consider the time limit for that clause and the proviso to section 12A(1)(ac) of the Act, inserted by the Finance (No. 2) Act, 2024 with effect from 01.10.2024, which enables the Principal Commissioner or Commissioner to condone a delay for reasonable cause.
On the RPT Act, we refrain from expressing any view on whether registration under that Act is a requirement material for achieving the objects of the Assessee within the meaning of section 12AB(1)(b)(i)(B) of the Act. This is left open for the learned CIT(E) to decide after considering the reply of the Assessee. However, we are constrained to observe that the remark in para 3.5 of the impugned order, that an appeal before this Tribunal filed by an unregistered trust is not admissible under section 29 of the RPT Act, was beyond the authority of the learned CIT(E). The right of appeal against an order under section 12AB(1)(b) of the Act is conferred by section 253(1)(c) of the Act, and the admissibility of such an appeal is for this Tribunal to decide. Section 29 of the RPT Act speaks of suits to enforce a right on behalf of a public trust in a court. An authority whose order is under appeal cannot pronounce on the maintainability of the appeal against its own order. The remark is, therefore, of no consequence.
On genuineness, the learned CIT(E) has raised detailed queries which deserve full answers. At the same time, whether running a hostel for students is a charitable activity within section 2(15) of the Act turns on the objects in the trust deed, the nature. The impugned order holds the activity to be against the objects of the trust without examining the objects clause. This issue also needs a fresh look on proper material.
In these circumstances, the impugned order is set aside and the application of the Assessee in Form No. 10AB is restored to the file of the learned CIT(E) for a fresh decision on all the issues in accordance with law, after giving the Assessee a reasonable opportunity of being heard. The learned CIT(E) shall be free to call for any information and make such enquiries as considered necessary. The Assessee shall file complete replies with supporting evidence to all the queries and shall
ITA No. 653/JPR/2026 Shri Khandal Vipra Sewa Sansthan Trust not seek adjournments without reasonable cause. We make it clear that we have expressed no view on the merits of any of the issues. Ground No. 1 is allowed for statistical purposes. 11. Ground No. 2 is general in nature and calls for no adjudication. In Ground No. 3, the Assessee seeks costs. No case for costs is made out, as the matter is being restored for a fresh decision and nothing on record shows that the proceedings were initiated or conducted with any oblique motive. Ground No. 3 is dismissed. 12. In the result, the appeal filed by the Assessee is allowed for statistical purposes. Order pronounced in the open court on 26.10.2026
