What did the Tribunal hold?

The Tribunal condoned the delay of 223 days in filing the appeal, finding the assessee's reasons to be bona fide. Regarding the substantive issue, the Tribunal noted that the CIT(A) had issued six notices to the assessee, but there was no compliance. Despite this, considering the facts and circumstances and in the interest of justice, the Tribunal deemed it proper to remand the matter to the CIT(A) for fresh consideration. The assessee was granted liberty to file evidence in support of their claim. Consequently, the order of the CIT(A) was set aside, and the grounds raised by the assessee were allowed for statistical purposes. The ratio decidendi is that even in cases of non-compliance, a remand may be granted in the interest of justice to allow the assessee an opportunity to present their case, especially when the revenue does not object.

What were the facts?

The assessee, Gangarapu Uma Maheswari, filed an appeal before the Income Tax Appellate Tribunal (ITAT), Chennai, against an order dated 13.10.2025 passed by the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (NFAC), Delhi. The appeal pertained to Assessment Year 2023-24. The assessee's appeal to the ITAT was filed with a delay of 223 days, which was condoned by the Tribunal after finding the reasons to be bona fide. The Assessing Officer (AO) had completed the assessment under Section 143 read with Section 144B of the Income Tax Act, 1961, determining the total income at Rs.86,01,024/- as against the returned income of Rs.13,78,520/-, making an addition on account of interest from land acquisition. The CIT(A) had confirmed the AO's order ex parte.

What were the issues?

1. Whether the delay of 223 days in filing the appeal before the ITAT should be condoned? The assessee argued that the reasons for the delay were bona fide and prevented timely filing. The revenue did not report any objection to the condonation. 2. Whether the matter should be remanded to the CIT(A) for fresh consideration? The assessee prayed for one more opportunity to furnish all relevant documents before the CIT(A) in support of the claim. The revenue reported no objection to this request. The Tribunal had to decide if the ex parte confirmation by the CIT(A) was justified, considering the assessee's request for an opportunity to present evidence.

3.

At the outset, it is noted that the AO completed the assessment by determining the total income of the assessee at Rs.86,01,024/- as against the returned income of Rs.13,78,520/-, inter alia, making an addition on account of interest from land acquisition, vide his order dated 30.01.2025, passed under Section 143 read with Section 144B of the Act. Aggrieved by the said order, the assessee filed an appeal before the Ld. CIT(A), wherein the Ld. CIT(A) confirmed the order of the AO ex parte of assessee.

4.

The Ld. AR Mr. T. Vasudevan, Advocate prayed for one more opportunity, submitting that the assessee is ready to furnish all relevant documents before the Ld. CIT(A) in support of the claim.

5.

The Ld. DR, Ms. Anshu Sharawat, Addl. CIT, reported no objection.

6.

After hearing both the parties and on perusal of the impugned order, particularly Para 6 thereof, we note that the Ld. CIT(A) issued six notices, but no compliance whatsoever was made by the assessee. In the absence of any compliance, the Ld. CIT(A) confirmed the addition made by the AO on account of interest from land acquisition. Therefore, considering the facts and circumstances of the case and in the interest of justice, we deem it proper to remand the matter to the file of the Ld. CIT(A) for fresh consideration. The assessee is at liberty to file evidences, if any, in support of his claim. Thus, the order of the Ld. CIT(A) is set aside, and the grounds raised by the assessee are allowed for statistical purposes.

7.

In the result, appeal of the assessee is allowed.
