DEPUTY COMMISSIONER OF INCOME TAX CENTRAL CIRCLE BAREILLY, AAYKAR BHAWAN vs. G SURGIWEAR LIMITED, VILLAGE RASOOLPUR
What did the Tribunal hold?
The Tribunal considered the submission by the learned CIT-DR that the present appeal was a duplicate of ITA No. 964/Lkw/2026, which was already filed by the Department for AY 2016-17 against the same order of the learned CIT(A) and was pending adjudication before the same Bench. The Tribunal noted that the current appeal had been filed after the earlier appeal. Therefore, the Tribunal permitted the Department to withdraw the present appeal without prejudice to its right to pursue ITA No. 964/Lkw/2026. The appeal was accordingly dismissed as withdrawn. No decision was made on the merits of the grounds of appeal raised by the Department.
What were the facts?
The appeal was filed by the Department (DCIT) against an order dated 02.06.2026 passed by the CIT(Appeals)-3, Lucknow. The CIT(Appeals) had partly allowed the assessee's (G. Surgiwear Limited) appeal against an assessment order under section 143(3) for Assessment Year 2016-17, dated 31.12.2018. The dispute pertained to the allowability of deduction under Section 35(2AB) of the Income Tax Act, 1961. The Department's appeal was listed for hearing on 15.10.2026. The assessee was not represented. The Revenue, through the CIT-DR, submitted that this appeal was a duplicate of another appeal, ITA No. 964/Lkw/2026, already filed for the same AY and against the same CIT(A) order, which was pending before the Tribunal.
What were the issues?
The Tribunal had to decide whether to proceed with the Department's appeal. The Revenue argued that the present appeal was a duplicate of ITA No. 964/Lkw/2026, filed for the same Assessment Year 2016-17 and against the same order of the CIT(Appeals). The Revenue requested permission to withdraw the current appeal without prejudice to its right to pursue the earlier filed appeal. The grounds of appeal, as listed by the Department, raised several issues concerning the allowability of deduction under Section 35(2AB), including the failure to comply with mandatory conditions like obtaining approval in Form 3CM and quantifying expenditure in Form 3CL, treating substantive conditions of Rule 6(7A) as procedural, the validity of a renewal letter as statutory approval, the assessee's responsibility for producing Form 3CL, the applicability of Section 35(3), and reliance on subsequent issuance of Form 3CL. The assessee did not present any arguments.

O R D E R PER NIKHIL CHOUDHARY, A.M.: This is an appeal filed by the department against the order of the ld. CIT (Appeals)-3, Lucknow dated 02.06.2026, wherein the learned CIT(A) had partly allowed the appeal of the assessee that was filed against the assessment order under section 143(3) of the Income Tax Act, 1961 (the Act), for the AY 2016-17 dated 31.12.2018. The grounds of appeal are as under:- “(i). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred in allowing deduction under Section 35(2AB) despite the assessee's failure to comply with mandatory statutory conditions, namely Approval in Form 3CM; and Quantification of expenditure in Form 3CL.
ITA No. 978/Lkw/2026 G. Surgiwear Limited
(ii). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred in treating the substantive conditions of Rule 6(7A) of the Income Tax Rules, 1962 as procedural formalities and in absence of compliances allowed the deductions under section 35(2AB) of the Act. (iii). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred in treating the "renewal letter" signed by Scientist-G as valid statutory approval although it was neither in the prescribed format nor issued by the competent authority as per Rule 6, therefore, the basic eligibility condition itself remains unfulfilled. (iv). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred inholding that the assessee is not responsible for production of Form 3CL, whereas it is a settled principle of law that the burden to substantiate a claim of deduction lies on the assessee. (v). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred in invoking section 35(3) of the Act to hold that the AO should have referred the matter to CBDT, whereas section 35(3) applies only where a technical question arises regarding nature of research. (vi). On the facts and in circumstances of the case and in law Ld. Commissioner of Income Tax (Appeals) has erred in placing his reliance on subsequent issuance of Form 3CL whereas the allow ability of deduction must be determined based on material available at the time of assessment and subsequent compliance cannot cure initial defects unless duly verified in accordance with law. (vii). The appellant craves leave to add, alter, amend or withdraw any ground of appeal at the time of hearing with the prior permission of the Hon'ble ITAT. ”
At the very outset when the case was taken up for hearing, the learned CIT-DR, Shri B. Shriniwas Kumar submitted that this was a duplicate appeal. The Department had already filed an appeal bearing ITA No. 964/Lkw/2026, for the AY 2016-17 against the said order of the learned CIT(A) which was pending for adjudication before this Bench. Accordingly, it was prayed that since this was a duplicate appeal on the same subject and having the same grounds of appeal and since this appeal has been filed after the appeal bearing ITA No. 964/Lkw/2026, the
ITA No. 978/Lkw/2026 G. Surgiwear Limited Department may be permitted to withdraw this appeal without prejudice to its right to pursue ITA No. 964/Lkw/2026.
There was no one present on behalf of the assessee at the time of hearing.
We have duly considered the matter. As the appeal in question is a duplicate of ITA No. 964/Lkw/2026 which has already been filed by the Department against the order of the learned CIT(A) dated 02.06.2026 for the AY 2016-17, we permit the Department to withdraw this appeal without prejudice to its right to pursue ITA No. 964/Lkw/2026. The appeal is accordingly dismissed as withdrawn.
In the result, the appeal is dismissed. Order pronounced on 29.10.2026 in the open Court.
