SALESFORCE.COM SINGAPORE PTE LIMITED vs. THE DEPUTY COMMISSIONER OF INCOME TAX, CIRCLE 3(1)(2), INTERNATIONAL TAXATION, NEW DELHI & ORS.
What did the High Court hold?
The High Court took on record the statements made by both the learned counsel for the petitioner and the learned Standing Counsel for the Revenue. The petitioner's counsel stated that while refunds and interest under Section 244A(1) have been granted for AYs 2017-18, 2018-19, 2020-21, and 2021-22, the benefit of Section 244A(1A) was not universally applied. The Revenue's counsel confirmed that an order under Section 244A(1A) for AY 2017-18 had been passed and assured that similar orders for other AYs and the refunds for AY 2018-19 and 2021-22 would be processed within two weeks. Based on these assurances, the Court disposed of the pending applications.
What were the facts?
The petitioner, Salesforce.com Singapore Pte Limited, filed two writ petitions (W.P.(C) 1913/2025 and W.P.(C) 1887/2025) before the Delhi High Court seeking directions for the grant of refunds along with interest under Section 244A of the Income Tax Act, 1961. These petitions pertained to Assessment Years (AY) 2018-19, 2020-21, 2021-22 (for W.P.(C) 1913/2025) and AY 2017-18 (for W.P.(C) 1887/2025). The High Court had previously disposed of these petitions on February 14, 2025, directing the revenue authorities to decide the refund claims expeditiously. Subsequent applications were filed by the petitioner seeking compliance with the earlier orders. The current proceedings address these compliance applications.
What were the issues?
1. Whether the respondents have complied with the directions of the High Court dated February 14, 2025, and July 25, 2025, regarding the grant of refunds and appropriate interest under Section 244A(1) and 244A(1A) of the Income Tax Act, 1961, for AY 2018-19, 2020-21, 2021-22, and 2017-18? Assessee's Contention: The petitioner argued that while orders granting effect to the ITAT's decisions have been passed for the mentioned assessment years, and interest under Section 244A(1) has been granted, the benefit of Section 244A(1A) has not been extended in all years. They also sought directions for the disposal of pending rectification applications. Revenue's Contention: The revenue stated that an order under Section 244A(1A) for AY 2017-18 has been passed. They further assured that similar orders would be passed for other AYs and follow-up action, including refund issuance for AY 2018-19 and 2021-22, would be completed within two weeks.
