What did the High Court hold?

The High Court disposed of the writ petition by directing the Appellate Authority (Commissioner of Income Tax (Appeals)) to consider and pass orders on the petitioner's appeal (Ext.P3) and stay petition (Ext.P4) expeditiously. Crucially, the Court directed that the Appellate Authority should do so without insisting on the payment of 20% of the tax liability. The Court also ordered that the demand notice for recovery shall be kept in abeyance until the interim application (stay petition) is disposed of. The Court did not explicitly decide on the merits of the deduction claim under Section 80P(2)(a)(i) but focused on the procedural aspect of the pre-deposit.

What were the facts?

The petitioner, The Vayala Service Co-operative Bank Ltd., filed a writ petition before the High Court of Kerala seeking a direction to respondents 2 and 3 (Income Tax Officer and Commissioner of Income Tax (Appeals)) not to insist on the payment of 20% of the assessed tax amount while considering its statutory appeal and stay application. The petitioner contended that the assessment order was erroneous as it is entitled to deduction under Section 80P(2)(a)(i) of the Income Tax Act. The petitioner relied on a Division Bench judgment of the High Court in support of its claim for waiver of the pre-deposit.

What were the issues?

1. Whether the petitioner, a Co-operative Bank, is entitled to a deduction under Section 80P(2)(a)(i) of the Income Tax Act, making the assessment order erroneous? 2. Whether the requirement to remit 20% of the assessed tax amount should be dispensed with for the petitioner, an Agriculture Co-operative Bank, while considering its statutory appeal and stay application? Assessee's Contentions: The petitioner argued that the assessment order was passed erroneously as it is entitled to deduction under Section 80P(2)(a)(i) of the Income Tax Act. It further contended that the 20% pre-deposit requirement should be waived as it is an Agriculture Co-operative Bank, relying on the Division Bench judgment of the High Court in Writ Appeal No.1529 of 2019 (Ext.P6). Revenue's Contentions: The judgment records that the learned standing counsel for the respondents appeared, but their specific contentions are not detailed.

JUDGMENT The Petitioner, a Co-operative Bank Ltd., has approached this Court for appropriate direction or order directing the respondent Nos.2 and 3 not to insist the petitioner to remit 20% of the tax amount assessed as per Ext.P2 assessment order while considering Ext.P3 statutory appeal and Ext.P4 stay application. Learned counsel appearing on behalf of the petitioner submits that the assessment Authority erroneously passed the assessment order as the petitioner is entitled to deduction as per Section 80P (2)(a)(i) of the Income Tax Act. Be that as it may, the remedy to challenge the order of such nature is to file an appeal before the appellate authority i.e., the Commissioner of Income Tax . The requirement of 20% of the demanded amount is liable to be WP(C).No.3346 OF 2020 -3- dispensed with as the petitioner is an Agriculture Co- operative Bank. In support of the aforementioned contention, relied upon the Division Bench judgment of this Court dated 01.07.2019 in Writ Appeal No.1529 of 2019 (Ext.P6). Having heard the learned counsel for the petitioner and the learned standing counsel for respondents, I am of the view that this writ petition can be disposed of directing the Appellate Authority to consider and pass orders on Ext.P3 appeal and Ext.P4 stay petition as expeditiously as possible, without insisting on payment of 20% of tax liability. Till such time the interim application is disposed of, the demand notice for recovery shall be kept in abeyance. AMIT RAWAL VV JUDGE
