What did the High Court hold?

The High Court directed the Commissioner of Income Tax (Appeals) to decide the appeal filed by Ranni Service Co-operative Bank Ltd. in accordance with the law. The decision must be made after providing the petitioner with an opportunity of being heard. This disposal is to be completed within three months from the date of receiving a copy of the judgment. Crucially, the court ordered that the Commissioner should not insist on the payment of 20% of the tax demanded, referencing a circular from 2017. Until the appeal is decided, recovery proceedings initiated based on the assessment order are to be kept in abeyance. The court did not decide on the merits of the appeal itself, but rather on the procedural aspect of its disposal.

What were the facts?

The petitioner, Ranni Service Co-operative Bank Ltd., filed a writ petition before the High Court of Kerala seeking a direction to the Commissioner of Income Tax (Appeals) to dispose of its appeal. The appeal was filed against an assessment order passed by the Income Tax Officer. The petitioner sought a speedy resolution of their appeal, which was pending before the second respondent. The court heard both parties before delivering its judgment.

What were the issues?

1. Whether the High Court should direct the Commissioner of Income Tax (Appeals) to dispose of the pending appeal filed by the petitioner? Assessee's Contention: The petitioner sought a direction for the expeditious disposal of their appeal before the Commissioner of Income Tax (Appeals). The petitioner relied on a circular of 2017, implying it might relate to conditions for appeal or stay of demand. Revenue's Contention: The judgment does not explicitly record any specific contentions raised by the revenue. However, the court's direction to dispose of the appeal without insisting on 20% of the tax demanded suggests that the revenue might have been seeking adherence to standard procedures which could include such pre-deposit requirements.
