What did the High Court hold?

The High Court held that all the writ petitions are disposed of in view of the directions passed by the Hon'ble Apex Court in Ashish Agarwal. Specifically, the Court directed that the impugned Section 148 notices issued under the unamended Section 148 of the IT Act shall be deemed to have been issued under Section 148A of the IT Act, as substituted by the Finance Act, 2021, and construed as show-cause notices in terms of Section 148A(b). The Assessing Officer is to provide information and material relied upon within thirty days, allowing assessees two weeks to reply. The requirement of conducting an enquiry under Section 148A(a) with prior approval is dispensed with as a one-time measure for notices issued under the unamended Act from April 1, 2021, till the date of the judgment. The Assessing Officers shall thereafter pass orders under Section 148A(d) and may issue notices under Section 148 as substituted. All defenses available to the assessees and the Revenue under the Finance Act, 2021, and in law shall continue to be available. Consequently, wherever assessment orders have been passed, they stand quashed and set aside, along with consequential orders/notices. The Revenue may restart the process as directed by the Apex Court. All rights and contentions of the parties are kept open.

What were the facts?

The petitioners, including Pride Purple Properties, Praful Shantilal Kothari HUF, Kuldeep Vyas, and Bhagyalaxmi Dairy Farms Private Limited, filed writ petitions before the Bombay High Court. These petitions challenged notices issued under Section 148 of the Income Tax Act, 1961. The High Court noted that these matters were covered by the Supreme Court's judgment in Union of India & Ors. vs. Ashish Agarwal. The Supreme Court had partially set aside the Allahabad High Court's order and provided specific directions regarding Section 148 notices issued under the unamended Act. The High Court's own judgment in Tata Communications Transformation Services Limited vs. Assistant Commissioner of Income Tax was also mentioned as being covered by the Apex Court's decision.

What were the issues?

1. Whether the Section 148 notices issued to the assessees, which were originally issued under the unamended Section 148 of the Income Tax Act, 1961, should be deemed to have been issued under Section 148A of the Income Tax Act, as substituted by the Finance Act, 2021, and treated as show-cause notices under Section 148A(b)? - Assessee: The assessees contended that their cases are covered by the Supreme Court's judgment in Ashish Agarwal, which provides a specific framework for dealing with such notices. - Revenue: The Revenue concurred with the applicability of the Ashish Agarwal judgment. 2. Whether the requirement of conducting an enquiry under Section 148A(a) with prior approval of a specified authority should be dispensed with as a one-time measure for notices issued under the unamended Section 148 from April 1, 2021, till the date of the judgment? - Assessee: Implicitly, the assessees would benefit from this dispensation as per the Supreme Court's directions. - Revenue: The Revenue concurred with the dispensation as a one-time measure.

Which sections of the Income-tax Act were involved?
