VIPINKUMAR SHANTILAL DHABARIA vs. THE INCOME TAX OFFICER WARD 3 4 THANE AND 2 ORS
What did the High Court hold?
The High Court held that since the petitioner had already availed of the statutory remedy by filing an appeal against the assessment order, and such appeal was pending, the writ petition under Article 226 of the Constitution of India would not be entertained. The Court reasoned that the Appellate Authority is bound by the decisions of the Jurisdictional High Court, including the ruling in Hexaware Technologies Limited. Therefore, it was open for the petitioner to raise all contentions, including the alleged illegality of the notice under Section 148, before the appellate authority. The Court rejected the petitioner's plea that the appeal would take too long, stating that the appellate authority must consider the binding pronouncements of the High Court. The assessment order was directed to remain stayed until the appellate proceedings were decided. All contentions of the parties on the pending proceedings were expressly kept open. The petition was disposed of in terms of the order.
What were the facts?
The petitioner, Vipinkumar Shantilal Dhabaria, filed a writ petition challenging notices under Section 148 of the Income Tax Act, 1961, an order dated April 13, 2022, and an assessment order dated March 27, 2024, passed by the Income Tax Officer, Ward-3(4), Thane. The petitioner argued that the notices and order were illegal based on the High Court's decision in Hexaware Technologies Limited Vs. Assistant Commissioner of Income Tax. The Revenue contended that the petitioner had already availed of an alternative statutory remedy by filing an appeal against the assessment order, which was pending before the Commissioner of Income-tax (Appeals). The High Court noted that a final assessment order had been passed and was under appeal. The Court also referred to a previous decision in Rajan Pradeepkumar Dubey vs. Income Tax Officer Ward 3-2, Kalyan & Ors. where a similar writ petition was not entertained due to a pending appeal.
What were the issues?
1. Whether the impugned notices under Section 148 and the subsequent assessment order are illegal in light of the decision in Hexaware Technologies Limited Vs. Assistant Commissioner of Income Tax, concerning the provisions of Section 151A and Section 151 of the Income Tax Act, 1961? (Question of law) Assessee's Contention: The petitioner argued that the notices and order were illegal as per the High Court's ruling in Hexaware, implying a procedural or substantive flaw in the re-assessment proceedings. The petitioner also expressed concern that the appeal process might take a long time, leaving the 'sword of litigation' hanging. Revenue's Contention: The Revenue argued that the petitioner had already availed of the statutory remedy by filing an appeal against the assessment order. They contended that the Appellate Authority and Revisional Authority are bound by the High Court's decisions in Hexaware and Siemens Financial Services Pvt. Ltd. and would consider these legal positions during the adjudication of the pending proceedings. Therefore, the writ petition should not be entertained.

this petition by the following order: ORDER i) The petitioner shall pursue the proceedings before the CIT(A) against the impugned assessment order as also the proceedings before the Revisionary Authority. It is open to the petitioner to raise contentions in regard to the illegality of the notice issued to the petitioner under Section 148, in the light of the decisions of this Court in Hexaware and Siemens (supra). ii) Till the proceeding before the Appellate Authority or Revisionary Authority are decided, the impugned assessment order shall remain stayed. iii) All contentions of the petitioner on the pending proceedings are expressly kept open.” 950.WP10931_2024.docx
In light of the aforesaid observations, we need to be consistent in our approach. We may observe that the appellate authority is bound by the decisions of the Jurisdictional High Court. Thus, in the facts and circumstances of this case, it is open to the petitioner to raise in the appellate proceedings, all such pleas as raised in the present petition. Certainly, the appellate authority would consider all the pleas which the petitioner intends to urge including that the notice under Section 148 issued is itself illegal in view of what has been held in the decision of this Court in Hexaware.
The justification of the petitioner to pursue this petition is that the appeal would take many years to be adjudicated and the sword of litigation would remain hanging over the head of the petitioner, despite the law having been declared in Hexaware. We are hesitant to accept such plea as urged on behalf of the petitioner for the reason that since the petitioner intends to contend in the appellate proceedings that the proceedings stand covered by the authoritative pronouncement of this Court, such plea certainly needs to weigh with the appellate authority. On such plea being made, the appellate authority is bound to consider the 950.WP10931_2024.docx
same and pass appropriate orders. Even this Court in several cases in which appeals were not filed, entertaining such plea, have disposed of the petitions considering the binding decision of this Court in Hexaware and in other decisions involving the issues as arising under Section 144B, 151A, 148A and 148 of the Income Tax Act, 1961. We may also observe that in such proceedings, the Revenue had fairly taken a position that the proceedings stand covered by such decisions of this Court.
In the aforesaid circumstances, we are inclined to dispose of this petition by the following order: ORDER i) The petitioner shall pursue its appeal already filed before the Commissioner of Income-tax, Appeals, against the impugned assessment order. It is open to the petitioner to raise contentions on the impugned notice and the order having become untenable, in the light of the decision of this Court in Hexaware. ii) We also permit the petitioner to file an application before the appellate authority praying that the appeal itself be disposed of in view of the decision of this 950.WP10931_2024.docx
Court in Hexaware. If such an interim application is made, certainly the appellate authority shall expeditiously consider the petitioner’s application and all contentions raised thereon. iii) Until the proceedings before the appellate forum are decided, the impugned assessment shall not be acted upon. iv) All contentions of the parties on the pending proceedings are expressly kept open.
Disposed of in the above terms. No costs. [ SOMASEKHAR SUNDARESAN, J.] [G. S. KULKARNI, J.] Signed by: Vidya S. Amin Designation: PS To Honourable Judge Date: 09/09/2024 14:20:41
