AI SummaryDismissed

What did the Tribunal hold?

The Tribunal dismissed both appeals of the assessee in limine for non-prosecution. The reasoning was based on the assessee's consistent non-compliance at various stages of the proceedings. The assessee was non-compliant before the Assessing Officer, completely non-compliant before the CIT(A) despite opportunities, and then filed appeals before the Tribunal with a delay. Subsequently, the assessee remained non-compliant and unresponsive to notices during the Tribunal's hearings. The Tribunal noted the strange circumstance of the assessee emerging for partial compliance before the Assessing Officer, then remaining completely non-compliant, and finally filing an appeal only to remain unresponsive. The Tribunal considered it proper to dismiss the appeals for non-prosecution, as attempts to serve notices were unsuccessful due to the assessee's unresponsiveness and failure to be found at the given address. No decision was made on the merits of the assessment orders.

What were the facts?

The assessee, Rajiv Suryakant Randhanpura, filed appeals before the ITAT Ahmedabad against the orders of the CIT(A), NFAC, Delhi, for Assessment Years 2017-18 and 2018-19. The Assessing Officer had rejected the assessee's books of account, estimated gross profit at 0.5% for AY 2017-18 and 4% for AY 2018-19, and made an addition of Rs. 10,00,00,000/- in AY 2017-18 from sundry creditors. The assessee was largely non-compliant during the assessment proceedings. Subsequently, the assessee was also non-compliant before the CIT(A), despite several opportunities, leading to the dismissal of appeals. The assessee filed appeals before the ITAT with a significant delay, attributing it to the appellate order being sent to an ex-Chartered Accountant's email. The assessee remained non-compliant during the ITAT hearings, and notices sent to the assessee's address could not be served.

What were the issues?

1. Whether the appeals filed by the assessee are maintainable in light of significant delay and subsequent non-prosecution. Assessee's contentions (implied by filing appeal and condonation application): The delay in filing the appeal was due to the appellate order being sent to the wrong email address, and the assessee was unaware of the order until discovery on 04-02-2026. The assessee subsequently engaged a new Chartered Accountant and filed the appeal. Revenue's contentions (implied by the Tribunal's decision): The assessee has been consistently non-compliant throughout the proceedings, first before the Assessing Officer, then before the CIT(A), and finally before the Tribunal. Despite opportunities and directions for service of notice, the assessee has remained unresponsive, leading to the inability to serve notices and the non-prosecution of the appeals.

Rajiv Suryakant Income Tax Officer, Randhanpura Ward-4(2)(4), Vs Ahmedabad S No 56/20,Piraji Nagar, Aayakar Bhavan,Ashram Near Transformer, Road, Ahmedabad- Wadgaonsheri, Pune- 380009 411014, Maharashtra Ahmedabad-380009, Gujarat PAN: ABRPR6080R (Respondent) (Appellant) Assessee by: None Revenue by: Shri Ram Tiwari, CIT-DR Date of hearing : 26-10-2026 Date of pronouncement : 27-10-2026 आदेश/ORDER PER TAPAS RAM MISRA, JUDICIAL MEMBER:

These present appeals have been filed by the Assessee against the order of the Ld. Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (hereinafter referred to as “NFAC”), Delhi (hereinafter referred to as “CIT(A)”), dated 24.07.2024 passed under Section 250 of the Income Tax Act, 1961 (hereinafter referred to as the “Act”) and relate to Assessment Years (A.Ys.) 2017-18 & 2018-19 respectively.

2.

In both these cases, the assessee’s books of account have been rejected and the assessee’s working of the gross profit ratio of Rs.0.05% for the Asst. Year 2017-18 and 0.01% for the Asst. Year 2018-19 has been rejected by the assessing officer and the gross profit has been estimated at 0.5% on the total turnover for Asst. year 2017-18 and at 4% of the total turnover for Asst. year 2018-19. In addition to the above, the assessing officer has made an addition of Rs.10,00,00,000/- in Asst. Year 2017-18 out of the sundry creditors of the assessee as unexplained cash credits.

3.

In both these years, the assessee has been largely non- compliant at the time of assessment and that appears to be the main reason why the assessing officer felt constrained to reject the books of account and make large additions on estimate. The assessee has thereafter filed appeals against both the assessment orders before the Ld. CIT(A), NFAC. Once again at the time of hearing of the appeals, the assessee has been completely non- compliant and submitted no response despite several opportunities provided by the CIT(A). In view of the non- compliance by the assessee, the Ld. CIT(A) dismissed the assessee’s appeals.

4.

Before us, the assessee filed the appeals against the orders of the CIT(A) after a significant delay. In the application for condonation of delay filed alongwith the appeal, it is stated by the assessee that the appellate order was sent electronically on the email ID of the assessee’s Chartered Accountant whose services were not being used by the assessee in 2024 and therefore the assessee remained totally unaware of the appellate 2 order. The said order was discovered on 04-02-2026 and thereafter the assessee engaged a new Chartered Accountant and filed the appeal.

5.

Surprisingly in the hearing before us on 10-06-2026, 27-08- 2026 and 26-10-2026 none was present for the assessee. On 27- 08-2026, the Bench had directed that notice of hearing be sent by Speed Post or through the DR. The Ld. D.R. had made an attempt to serve the notice through the ITO, Ward-7(3), Pune. The ITO, Pune reported that an Inspector was sent to the assessee’s address who failed to find any person named Shri Rajiv Suryakant Randhanpura as staying at that address. The notice therefore remains unserved.

6.

This creates a strange circumstance where the assessee emerges for partial compliance before the assessing officer, then remains completely non-compliant before the CIT(A) and then files an appeal before the Tribunal and also files an application for condonation of delay and thereafter again remains non- compliant and unresponsive to notices. We therefore consider it proper to dismiss the assessee’s appeal in limine for non- prosecution.

7.

In the result, both the appeals of the Assessee are dismissed.
