THE NATTAKAM SERVICE CO-OPERATIVE BANK LIMITED, NO.3839 vs. THE INCOME TAX OFFICER (TDS)
What did the High Court hold?
The High Court of Kerala disposed of the writ petition by directing the second respondent, the Commissioner of Income Tax (Appeals), to consider and pass orders on the stay petitions (Exts.P10 and P11) within four months from the date of receiving a copy of the judgment, after hearing the petitioner. Recovery steps pursuant to the orders under challenge (Exts.P1 and P3) were directed to be kept in abeyance until the second respondent passes orders on the stay petitions and communicates them to the petitioner. Consequently, the orders of the first respondent (Exts.P8 and P9) directing payment of 20% of the amount were quashed. The petitioner was directed to furnish copies of the writ petition and the judgment to the second respondent. The court did not decide the merits of the appeals themselves, but rather facilitated the process of the appellate authority considering the stay applications.
What were the facts?
The petitioner, The Nattakam Service Co-operative Bank Limited, is challenging orders passed under Section 201(1)/201(1A) of the Income Tax Act, 1961 (referred to as Exts.P1 and P3). The petitioner has filed appeals (Exts.P5 and P6) along with stay petitions (Exts.P10 and P11) before the Commissioner of Income Tax (Appeals), the second respondent. While these appeals were pending, the petitioner approached the Income Tax Officer (TDS), the first respondent, for a stay. The first respondent, by orders Exts.P8 and P9, directed the petitioner to pay 20% of the disputed amount pending the appeal's disposal. The petitioner has filed the present writ petition before the High Court of Kerala seeking relief against these directions.
What were the issues?
1. Whether the High Court should intervene in the pending appellate proceedings by directing the Income Tax Officer (TDS) to grant a stay on recovery proceedings, considering the petitioner has already filed stay petitions before the appellate authority? Assessee's Contention: The petitioner argued that they have filed stay petitions before the appellate authority (second respondent) and that recovery steps should be kept in abeyance until the appellate authority decides these petitions. They also sought to quash the orders of the first respondent directing payment of 20% of the demand. Revenue's Contention: The judgment does not record any specific arguments made by the revenue's standing counsel. However, the context implies the revenue's position would be to uphold the orders of the Income Tax Officer (TDS) and the Commissioner of Income Tax (Appeals) regarding the demand and recovery.

JUDGMENT Against Exts.P1 and P3 orders under Section 201(1)/201(1A) of the Income Tax Act, the petitioner has preferred Exts.P5 and P6 appeals together with Exts.P10 and P11 stay petitions before the 2nd respondent. It is the case of the petitioner that during the pendency of the appeal, and with a view to keeping in abeyance recovery steps, he had approached the 1st respondent for a stay and the 1st respondent by Exts.P8 and P9 orders had directed a payment of 20% of the amount pending disposal of the appeal.
I have heard the learned counsel appearing for the petitioner and also the learned Standing counsel appearing for the respondents. On a consideration of the facts and circumstances of the case as also the submissions made across the Bar, I find that the petitioner has preferred Exts.P10 and P11 stay petitions before the 2nd respondent appellate authority and the said authority is in seisin of the same. Under the said circumstances, I am of the view that recovery proceedings pursuant to Exts.P1 and P3 orders can be kept in abeyance till such time as the first appellate authority considers the stay petition. Accordingly, I dispose the Writ Petition by directing the 2nd respondent to consider and WP(C).No.15042 OF 2020 3 pass orders on Exts.P10 and P11 stay petitions within four months from the date of receipt of a copy of this judgment, after hearing the petitioner. Recovery steps for recovery of amounts confirmed against the petitioner by Exts.P1 and P3 orders shall be kept in abeyance till such time as orders are passed by the 2nd respondent as directed above and communicated to the petitioner. Further, in view of the above directions to the appellate authority, Exts.P8 and P9 orders of the 1st respondent are quashed. The petitioner shall produce a copy of the writ petition together with a copy of this judgment, before the 2nd respondent, for further action. A.K.JAYASANKARAN NAMBIAR
