What did the High Court hold?

The High Court of Kerala directed the 3rd respondent, the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (NFAC), Delhi, to consider the stay petition filed by the petitioner (Ext.P4) expeditiously, at any rate, within a period of three months from the date of receipt of a copy of the judgment. Furthermore, the Court ordered that all coercive proceedings against the petitioner, pursuant to the penalty order (Ext.P1), shall be kept in abeyance until the stay petition is considered. The writ petition was disposed of with these directions. The substantive appeal itself was not decided on merits.

What were the facts?

The petitioner, Yeroor Service Co-operative Bank Ltd. No. 1816, is a Primary Agricultural Credit Society. This writ petition was filed seeking a direction for the timely disposal of the pending appeal.

What were the issues?
