MAHESWARI TEXTILES vs. INCOME TAX OFFICER
What did the High Court hold?
The High Court disposed of the writ petition by directing that if the petitioner files a stay petition either through the e-filing portal of the National Faceless Appeal Centre or before the jurisdictional Assessing Officer, any proceedings for recovery of amounts under the assessment order (Ext.P1) shall be kept in abeyance until a decision is taken on the stay petition. This benefit is contingent upon the stay petition being filed within ten days from the date of the order. The Court did not decide on the merits of the appeal or the stay petition itself, but provided a procedural direction to facilitate the consideration of the stay application.
What were the facts?
The petitioner, Maheswari Textiles, received an order of assessment (Ext.P1) for assessment year 2017-18. Aggrieved, they filed an appeal (Ext.P2) before the National Faceless Appeal Centre. No stay application was filed. The petitioner approached the High Court of Kerala, aggrieved by a demand notice (Ext.P3) issued pending the appeal. The respondent department indicated that the e-filing portal was open for filing a stay petition, or it could be filed before the jurisdictional Assessing Officer for transfer to the National Faceless Appeal Centre.
What were the issues?
1. Whether the petitioner is entitled to have recovery proceedings stayed pending the decision on their appeal before the National Faceless Appeal Centre, considering the issuance of a demand notice during the pendency of the appeal. Assessee's Contention: The petitioner argued that recovery proceedings should be kept in abeyance until a decision is taken on their stay petition, which they intended to file as per the suggestions of the revenue. Revenue's Contention: The revenue submitted that the e-filing portal was open for the petitioner to file a stay petition, and if unable to do so, they could file it before the jurisdictional Assessing Officer for onward transmission to the National Faceless Appeal Centre.
