THE PLANTATION CORPORATION OF KERALA LTD vs. THE ASSISTANT COMMISSIONER OF INCOME TAX
What did the High Court hold?
The High Court of Kerala disposed of the writ petition by directing the Commissioner of Income Tax (Appeals) to pass orders on the stay petitions (Exts.P11 and P17) filed by the petitioner along with their appeals (Exts.P8 and P14). The Court ordered that this should be done expeditiously, within 8 weeks of the production of the judgment copy, and with notice to the petitioner. The Court also stayed steps for recovery of tax due under the assessment orders until the disposal of the stay petitions. The High Court did not decide the merits of the assessment orders themselves, leaving the decision on the stay and the appeals to the appellate authority.
What were the facts?
The petitioner, The Plantation Corporation of Kerala Ltd., a government company, is aggrieved by assessment orders for Assessment Years 2004-05 (Ext.P7) and 2005-06 (Ext.P13), passed by the Assistant Commissioner of Income Tax, Circle-1, Kottayam. The petitioner filed appeals (Exts.P8 and P14) and stay petitions (Exts.P11 and P17) before the Commissioner of Income Tax (Appeals)-IV, Kochi. While these appeals and stay petitions were pending, the petitioner approached the High Court of Kerala apprehending revenue recovery steps. The petitioner also filed applications under Section 220(6) for stay of demand, which were rejected by the Assistant Commissioner (Exts.P10 and P16).
What were the issues?
1. Whether the High Court should entertain a writ petition when statutory appeals and stay petitions are pending before the appellate authority, particularly when revenue recovery is apprehended. Assessee's Contention: The petitioner, aggrieved by the assessment orders, has filed appeals and stay petitions before the Commissioner of Income Tax (Appeals). However, apprehending immediate revenue recovery action, they have approached the High Court for appropriate directions. Revenue's Contention: The standing counsel for the respondent was heard. No specific arguments on the merits of the assessment or the maintainability of the writ petition were recorded, other than acknowledging the pendency of appeals and stay petitions.
Which sections of the Income-tax Act were involved?
Section 143(1),Section 143(2),Section 143(3),Section 147,Section 220(6)
