What did the High Court hold?

The High Court held that it would not like to exercise its writ jurisdiction parallelly when the appellate authority is seized of the matter. Therefore, instead of deciding the merits of the case, the Court directed the 2nd respondent (National Faceless Appeal Centre, Delhi) to decide the appeal pending before it in accordance with the law within a period of two months. If a final decision on the appeal is not possible within two months, the stay application is to be decided within the same period. The writ petition is disposed of with these directions, and no coercive proceedings are to be initiated against the petitioner until a decision is taken on the stay application. The Court did not decide the merits of the appeal or the stay petition.

What were the facts?

The petitioner, M/s. Prathibha Traders, is challenging an assessment order dated March 26, 2022, for assessment year 2017-18. The total income was assessed at Rs. 34,14,093 under Section 147 read with Sections 144 and 144B of the Income Tax Act, 1961. A demand notice was issued, and penalty proceedings were initiated. The petitioner filed an appeal (Exhibit P-2) and a stay petition (Exhibit P-3) before the 2nd respondent (National Faceless Appeal Centre, Delhi) on April 6, 2023. However, no decision has been taken on the appeal or stay petition, and the petitioner is facing recovery proceedings. The writ petition seeks a direction for the 2nd respondent to dispose of the appeal and stay petition and to stay coercive recovery proceedings until a decision is made.

What were the issues?

1. Whether the High Court should exercise its writ jurisdiction to direct the disposal of an appeal and stay petition when the appellate authority is seized of the matter? (Question of law) Assessee's Contention: The petitioner argues that despite filing the appeal and stay petition promptly, no decision has been taken, and they are facing recovery proceedings. They seek a direction for the 2nd respondent to decide the appeal and stay application in a time-bound manner and to stay coercive proceedings until a decision is rendered. Revenue's Contention: The judgment does not record any specific contentions from the revenue regarding the delay in disposal or the exercise of writ jurisdiction.
