What did the High Court hold?

The High Court of Kerala dismissed the writ petition challenging Ext.P7 order. The Court noted the apprehension of the petitioner that Ext.P7 would be the final assessment order. However, in light of the assurance given by the learned Standing Counsel for the respondent that the assessment proceedings under Section 147 would only be completed after issuing a notice under Section 143(2) and providing the petitioner with a hearing, the Court found no reason to interfere with Ext.P7. The operative direction was to dismiss the writ petition based on the respondent's statement. No specific issue was left undecided.

What were the facts?

The petitioner, Mr. Nagoor Jahangir Rawther, filed a writ petition challenging Ext.P7 order. This order was passed by the Assistant Commissioner of Income Tax, Corporate Circle 2(1), rejecting the petitioner's objections against a proposal to reopen his assessment under Section 147 of the Income Tax Act. The respondent's action was in compliance with the Supreme Court's judgment in GKN Driveshafts (India) Ltd. and others v. Income Tax Officer and Others. The petitioner apprehended that Ext.P7 would effectively be the final assessment order under Section 147, denying him further opportunity to contest its findings.

What were the issues?

1. Whether Ext.P7 order, rejecting the petitioner's objections to a proposal for reopening of assessment under Section 147, would preclude the petitioner from further contesting the findings in a subsequent assessment order. Assessee's Contention: The petitioner argued that Ext.P7 order would effectively serve as the assessment order under Section 147, thereby denying him any further opportunity to contest the findings. Revenue's Contention: The learned Standing Counsel for the respondent assured the Court that the proceedings for completing an assessment under Section 147 would only culminate after the issuance of a notice under Section 143(2) and a subsequent hearing of the petitioner.

Which sections of the Income-tax Act were involved?

Section 147,Section 143(2)

OTHER PRESENT: SC, JOSE JOSEPH THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 13.11.2019, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

W.P(C) No.30506/19 2 JUDGMENT The challenge in the writ petition is against Ext.P7 order of the respondent, which rejects the objections preferred by the petitioner against a proposal for reopening of the assessment under the Income Tax Act under Section 147. The said order ( Ext.P7) was passed pursuant to the obligation of the respondent flowing from the judgment of the Supreme Court in GKN Driveshafts (India) Ltd. and others v. Income Tax Officer and Others [259 ITR 19]. The apprehension of the petitioner is that Ext.P7 would virtually be the assessment order passed under Section 147 of the Act and that no further opportunity would be given to the petitioner for contesting the findings in Ext.P7 order. The learned Standing Counsel for the respondent submits that the proceedings for completing an assessment under Section 147 will culminate only after issuance of a notice under Section 143(2) to the petitioner and thereafter hearing the petitioner. In the light of the said assurance of the learned Standing Counsel for the respondent, I see no reason to interfere with Ext.P7 order impugned in this writ petition. The writ petition is therefore dismissed in its challenge against Ext.P7 order and recording the statement of the learned Standing Counsel for the respondent. Sd/- A.K.JAYASANKARAN NAMBIAR
