What did the High Court hold?

The High Court disposed of the writ petition by directing the respondents to provide a link to the petitioner for uploading a stay application in the appeal preferred by him. This was to be done within two weeks of receiving a certified copy of the judgment. The petitioner was then required to file the stay application within 10 days of receiving the link. If the stay application was filed within the stipulated time, recovery proceedings for any amount due under the assessment order (Ext. P9) would be kept in abeyance until a decision was taken on the stay application. The Court did not decide on the merits of the stay itself but facilitated the process for the petitioner to file one.

What were the facts?

The petitioner, M.T. Abdul Subair, is aggrieved by an order of assessment for the assessment year 2017-2018, bearing reference Ext. P9. He has filed an appeal (Ext. P20) before the National Faceless Appeal Centre, which is pending. However, the petitioner had not filed any stay petition along with his appeal. This writ petition was filed seeking a stay on recovery proceedings pending the appeal. The respondents' counsel indicated that a link for uploading a stay petition could be provided on this Court's direction, citing similar past orders.

What were the issues?

1. Whether the petitioner is entitled to a stay of recovery proceedings pending the disposal of his appeal before the National Faceless Appeal Centre, considering he has not filed a stay petition. Assessee's Contention: The petitioner, aggrieved by the assessment order, has filed an appeal and seeks a stay on recovery proceedings. The judgment does not explicitly record the petitioner's arguments regarding the merits of a stay, but the filing of the writ petition implies a request for interim relief. Revenue's Contention: The revenue's counsel stated that the petitioner had not preferred any stay application along with the appeal and that the National Faceless Assessment Centre could provide a link for uploading a stay petition on the Court's direction, as has been done in similar cases.
