VEENA GOYAL W/O LATE SHRI SUBHASH CHANDRA GOYAL vs. ASSISTANT COMMISSIONER OF WEALTH TAX
What did the High Court hold?
The High Court allowed the appeals, setting aside the impugned order of the ITAT. The Court condoned the delay of 178 days in filing the appeal. The reasoning was that there was confusion regarding the introduction of faceless hearing, leading the appellant to file an appeal with CIT(A) Jaipur but receive notices from CIT(A) Delhi. The issue of jurisdiction was raised, along with a prayer for transfer to Jaipur, which was not considered. The appellant's subsequent approach to the Principal Chief Commissioner of Income Tax, Jaipur, for recalling the order and transfer was based on mistaken advice and a bonafide ground of wrong advice in pursuing the appropriate remedy. The Court found the delay sufficiently explained. The matter was remitted back to the Tribunal to decide the appeal on merits. No issue was expressly left undecided.
What were the facts?
These appeals by Manuj Goyal and Veena Goyal (appellants) challenge the order of the Income Tax Appellate Tribunal (ITAT) dated 29.03.2023. The ITAT had rejected the appellants' appeal due to a delay of 178 days in filing it. The underlying dispute stems from a wealth tax assessment finalized after a survey conducted on 17.08.2017 & 18.08.2017. The appellants had filed an appeal before the CIT(A) Jaipur, but received a notice of hearing from CIT(A) Delhi. They requested a transfer of the appeal to Jaipur due to jurisdictional concerns, which was allegedly not addressed. The CIT(A) rejected the appeal on 30.03.2022. Subsequently, an application to recall the order was filed before the Principal Chief Commissioner of Income Tax, Jaipur, which received no reply. This led to the present appeal before the ITAT, where the delay in filing was the primary hurdle.
What were the issues?
1. Whether in law the Ld. ITAT was right in deciding the matter merely on the basis of the delay in filing the case without touching the merits and jurisdictional issues of the case. Assessee's contentions: The appellant argued that the delay in filing the appeal was bonafide and sufficiently explained. They contended that they were pursuing the issue of jurisdiction before the CIT(A) Delhi, and their request for transfer of the case to Jaipur was not considered. They also stated that they were pursuing a remedy under mistaken advice by approaching the Principal Chief Commissioner of Income Tax, Jaipur, for recalling the order and transfer of the appeal. Revenue's contentions: The respondent defended the impugned order. They submitted that the application filed before the Principal Chief Commissioner of Income Tax, Jaipur, was not a statutory remedy.
