What did the High Court hold?

The High Court directed the 3rd respondent (Commissioner of Income Tax (Appeals)) to consider the stay petition (Ext.P3) expeditiously, within two months from the date of receipt of a copy of the judgment. The Court further ordered that all recovery proceedings pursuant to the penalty order (Ext.P1) and the demand notice (Ext.P4) shall be deferred until orders are passed on the stay petition. The writ petition was disposed of with these directions. The Court did not decide on the merits of the penalty or the deduction claim, focusing solely on the procedural aspect of recovery pending appeal.

What were the facts?

The petitioner, Muttathara Service Co-operative Bank Ltd., is an assessee under the Income Tax Act, 1961. For the assessment year 2012-2013, the petitioner claimed a deduction under Section 80(P) of the Act. However, this claim was rejected, and a penalty order under Section 271(1)(c) of the Act was issued (Ext.P1). The petitioner filed an appeal (Ext.P2) before the Commissioner of Income Tax (Appeals) under Section 246A, along with a stay petition (Ext.P3). Despite the pending appeal and stay petition, the Assessing Authority issued a notice of demand (Ext.P4) under Section 156 of the Act, pursuant to the penalty order. Aggrieved by this, the petitioner approached the High Court.

What were the issues?

1. Whether the recovery proceedings initiated pursuant to the penalty order and demand notice are valid when a statutory appeal and a stay petition are pending before the appellate authority? The assessee argued that the issuance of a demand notice under Section 156, despite a pending appeal and stay petition, is premature and prejudicial to their interests. They contended that the recovery proceedings should be deferred until the appellate authority decides on the stay petition. The revenue did not record any specific arguments in the judgment regarding this issue.

Which sections of the Income-tax Act were involved?
