THE COMMISSIONER OF INCOME TAX vs. M/S. ADVANTA INDIA LTD.
What did the High Court hold?
The High Court held that in view of CBDT Circular No. 21/2015 dated December 10, 2015, which enhanced the monetary limit for filing appeals before the High Court to Rs. 20 lacs and applied retrospectively to pending appeals, the present appeal should be dismissed. The Revenue's counsel confirmed that the tax effect in this appeal was below the Rs. 20 lacs limit. Therefore, the appeal was dismissed on the grounds of the revised monetary threshold for appeals. No decision was made on the merits of the original dispute between the assessee and the Revenue.
What were the facts?
This case involves an appeal filed by the Revenue (Commissioner of Income Tax and Deputy Commissioner of Income Tax) against an order passed by the Income Tax Appellate Tribunal (ITAT) in ITA No. 825/BANG/2010. This circular was stated to apply retrospectively to pending appeals.
What were the issues?
