THE COMMISSIONER OF INCOME TAX vs. M/S EXPERT OUTSOURCE PVT LTD
What did the High Court hold?
The High Court held that the substantial questions of law raised in the appeal were answered against the revenue in its own previous decision in ITA No.323/2010 dated 01.03.2011. Therefore, the appeal filed by the Revenue was dismissed. The reasoning implies that the ITAT's decision, which was in favour of the assessee on both the issues of STPI approval timing and the utilization of existing plant and machinery, was upheld based on the High Court's prior ruling. The principle established is that if prior High Court decisions have settled similar questions of law against the revenue, subsequent appeals on identical grounds are likely to be dismissed. No issue was expressly left undecided.
What were the facts?
The appeal is filed by the Commissioner of Income Tax and the Income-Tax Officer (Revenue) against the order of the Income Tax Appellate Tribunal (ITAT), Bangalore, dated 31/10/2011 in ITA No.95/Bang/2011. The assessee is M/s Expert Outsource Pvt Ltd. The dispute pertains to Assessment Year(s) not explicitly stated but implied to be related to the period when the assessee claimed deduction under Section 10A of the Income Tax Act, 1961. The core issue revolves around the eligibility of the assessee for Section 10A deduction despite alleged non-compliance with conditions related to STPI approval and the utilization of existing plant and machinery.
What were the issues?
1. Whether the Appellate Authorities erred in holding that the assessee is eligible for deduction under Section 10A of the Income Tax Act, 1961, even though the company was incorporated and commenced business activities before obtaining STPI approval, which was a prerequisite under Section 10A(2)(i)(b) & (c) of the Act, and this condition was not met? 2. Whether the Appellate Authorities failed to examine and record a finding that the STPI approval obtained on 04.08.2004 for establishing a Software Technology Park (STP) unit involved the utilization of previously used plant and machinery transferred to the STP unit to the extent of Rs. 2,80,154/-, which exceeds 20% of the total plant and machinery of the STP unit, as stipulated in Section 10A(2)(iii) of the Act? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the assessee did not satisfy the conditions precedent for claiming deduction under Section 10A, specifically regarding the timing of STPI approval and the extent of utilization of existing plant and machinery in the new STP unit.
Which sections of the Income-tax Act were involved?
Section 10A,Section 10A(2)(i)(b),Section 10A(2)(c),Section 10A(2)(iii),Section 260-A
