What did the High Court hold?

The High Court held that the appeal filed by the Revenue should be dismissed in view of CBDT Circular No. 21/2015 dated 10.12.2015. This circular enhanced the monetary limit for filing appeals before the High Court from Rs. 10 lacs to Rs. 20 lacs and clarified that it would apply retrospectively to pending appeals. The Revenue's counsel stated that the tax effect in the present appeal was below the revised limit of Rs. 20 lacs. Consequently, following the circular, the Court dismissed the appeal. No specific findings were made on the merits of the ITAT's order. The operative direction was to dismiss the appeal.

What were the facts?

The Revenue, comprising the Commissioner of Income Tax and the Assistant Commissioner of Income Tax, filed an appeal before the High Court of Karnataka against an order passed by the Income Tax Appellate Tribunal (ITAT), Bangalore. The appeal was filed under Section 260A of the Income Tax Act, 1961. The respondent in this appeal is M/s Sangam Enterprises. The procedural history leading to this appeal involves an order from the ITAT, Bangalore in IT(SS)A No. 62/BANG/2008, dated February 23, 2011, which is the subject of challenge. The specific amount in dispute is not explicitly stated but is referred to in terms of its 'tax effect'.

What were the issues?

1. Whether the appeal filed by the Revenue is maintainable in light of the revised monetary limits for filing appeals before the High Court as per Circular No. 21/2015 issued by the Central Board of Direct Taxes (CBDT)? (Question of law and fact, turning on the interpretation and applicability of the CBDT Circular). Contentions: Assessee: No specific contentions are recorded in the judgment for the assessee. Revenue: The Revenue contended that the tax effect in the present appeal is below the specified limit of Rs. 20 lacs, as enhanced by CBDT Circular No. 21/2015 dated 10.12.2015. They relied on this circular, which allows for pending appeals below the specified tax limits to be withdrawn or not pressed.
