CIT LUDHIANA vs. MUKESH MITTAL
What did the High Court hold?
The High Court dismissed the appeal as withdrawn, granting the revenue the liberty to file an application for revival of the appeal as prayed for. The Court clarified that the withdrawal of the appeal by the revenue would not be considered an affirmation of the Income Tax Appellate Tribunal's order on its merits. Furthermore, the legal issue, as claimed by the revenue, was left open to be adjudicated in an appropriate future case. The operative direction was the dismissal of the appeal as withdrawn with liberty.
What were the facts?
The appeal was filed by the Commissioner of Income Tax (Central), Ludhiana (the revenue) against Mukesh Mittal (the assessee). The tax effect involved in the appeal was ₹33,13,958/-. The revenue sought to withdraw the appeal in light of Circular No. 03/2018, dated 11.07.2018, issued by the Central Board of Direct Taxes. The revenue also prayed for liberty to file an application for revival of the appeal if something survived therein. The High Court considered the withdrawal request.
What were the issues?
1. Whether the revenue should be permitted to withdraw the appeal given the tax effect and the CBDT Circular? (Question of procedure/administrative policy) The revenue argued that due to the tax effect being below the threshold stipulated in Circular No. 03/2018, they had instructions to withdraw the appeal. They also requested liberty to revive the appeal if necessary. The judgment does not record any arguments from the assessee.
