What did the High Court hold?

The High Court held that it did not have the jurisdiction to entertain the appeal. This conclusion was based on the submission made by the respondent's counsel, which was not disputed by the appellant's counsel, that the assessment order was passed by the Assessing Officer at Delhi. The High Court relied on the Supreme Court's judgment in Principal Commissioner of Income Tax vs. ABC Papers Ltd. (2022) 447 ITR 1 SC, which clarifies the territorial jurisdiction for entertaining appeals under Section 260A of the Income Tax Act. Consequently, the appellant sought and was granted permission to withdraw the appeal with liberty to file it before the competent jurisdiction. No decision was made on the merits of the case.

What were the facts?

The appeal was filed by the Principal Commissioner of Income Tax, Faridabad, under Section 260A of the Income Tax Act, 1961, against an order passed by the Income Tax Appellate Tribunal, Delhi Bench 'B', dated 30.07.2021, for the assessment year 2010-11.
