PR COM MISSIONER OF INCOME TAX PANCHKULA vs. CHARAN DASS WALIA THROUGH LR ASHOK KUMAR
What did the High Court hold?
The High Court dismissed the appeal as withdrawn, granting the liberty prayed for by the appellant-revenue to file an application for revival of the appeal. The Court clarified that the withdrawal of the appeal by the revenue would not be considered an affirmation of the ITAT's order on merits. Furthermore, the legal issue claimed by the appellant-revenue was expressly left open to be adjudicated in an appropriate case. Any pending Civil Miscellaneous Application, if any, was also disposed of as the main case was dismissed.
What were the facts?
The appeal was filed by the Pr. Commissioner of Income Tax, Panchkula (appellant-revenue) against an order of the Income Tax Appellate Tribunal (ITAT). The respondent was Late Shri Charan Dass Walia through LR Ashok Kumar. The assessment year(s) are not specified. The specific order or action under challenge before the High Court is not detailed, but it stems from the ITAT's decision. The amount in dispute is not stated. The procedural history relevant to the High Court's decision is that the revenue sought to withdraw the appeal.
What were the issues?
The High Court was not required to decide any substantive legal issues on merits. The primary procedural matter was whether the appeal, as sought to be withdrawn by the revenue, should be dismissed. The revenue's contention was that the tax effect involved was below the monetary limit prescribed by CBDT Circular No.3 of 2018, as amended by Circular No.17 of 2019 and Letter No.F.No.279/Misc/M-93/2018-ITJ dated 20.08.2019, and therefore, they had instructions to withdraw the appeal. The revenue also prayed for liberty to file an application for revival of the appeal if something survived therein. No argument was recorded for the respondent.
