MOHAN LIFESPACES LLP AY 2017 18 vs. Assistant Commissioner of Income Tax Central Circle 1 Thane AND ORS
What did the High Court hold?
The High Court disposed of the Writ Petition by directing the Petitioner to pursue its appeal already filed before the Commissioner of Income Tax (Appeals) against the impugned Notice issued under Section 148 and the impugned Assessment Order. The Court explicitly kept open all contentions challenging the notice and the assessment order, on all grounds available to the Petitioner, including those raised in the Writ Petition, to be agitated before the CIT Appeals. Furthermore, the Court ordered that until the appeal before the CIT Appeals is decided, the impugned Assessment Order shall not be acted upon. The Court clarified that all contentions of all parties are expressly kept open to be agitated before the CIT Appeals, and these will be decided by the CIT Appeals on their own merits and in accordance with law. No order as to costs was made.
What were the facts?
The Petitioner, Mohan Lifespaces LLP, filed a Writ Petition before the Bombay High Court challenging a Notice dated 20.03.2024 issued under Section 148 of the Income Tax Act, 1961, and an Assessment Order dated 25.03.2025. The assessment year in question is 2017-18. The Petitioner sought to quash and set aside these notices and orders, and to prohibit the respondents (Assistant Commissioner of Income Tax and others) from proceeding further with the re-assessment. The Petitioner's counsel informed the Court that an appeal against the Assessment Order has already been filed before the Commissioner of Income Tax (Appeals) and is pending.
What were the issues?
1. Whether the Petitioner should be directed to pursue its pending appeal before the Commissioner of Income Tax (Appeals) against the impugned Notice under Section 148 and the Assessment Order, rather than proceeding with the Writ Petition. Assessee's Contention: The Petitioner, through its counsel, relied on the Bombay High Court's decision in Shantilal Prabhudas & Co. vs. Income-tax Officer [2025] 175 taxmann.com 303 (Bombay) to argue that in similar circumstances, the Court directed parties to pursue their pending appeals and kept the impugned order from being acted upon until the appeal was decided. Revenue's Contention: The learned counsel for the Respondents did not dispute the Petitioner's position regarding the pending appeal or that it was yet to be decided.

He relies on the decision of this Court in Shantilal Prabhudas & Co. vs. Income-tax Officer [2025] 175 taxmann.com 303 (Bombay) wherein under similar circumstances, this Court had directed the parties to pursue its Appeal already filed against the impugned Assessment Order and expressly kept open all contentions while observing that until the Appeal is decided, the impugned Assessment Order would not be acted upon. Mr. Kotangle, the learned counsel for the Respondents does not dispute the said position and the fact that the Appeal is yet to be decided.
