PR. COMMISSIONER OF INCOME TAX, CENTRAL II vs. M/S SOMANI WORSTED LIMITED
What did the High Court hold?
The Delhi High Court dismissed the appeal filed by the Revenue. The Court noted that the assessment year in question, 2011-12, when calculated from the satisfaction date of 24.05.2021, was beyond the 10-year limitation period. This was in line with the High Court's own previous decision in PCIT vs. Ojjus Medicare Pvt. Ltd. [2024] 161 taxmann.com 160 (Delhi). The Revenue's counsel could not present any contrary judgment and only mentioned that a Special Leave Petition was pending before the Supreme Court. As the law laid down in Ojjus Medicare still held field, the High Court followed that decision and dismissed the appeal. No specific issue was left undecided.
What were the facts?
The appellant, Pr. Commissioner of Income Tax, Central II, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 26.11.2025 passed by the Income Tax Appellate Tribunal (ITAT). The ITAT had dismissed appeals filed by the Revenue against an order dated 23.12.2024 by the Commissioner of Income Tax (Appeals). The assessment year in question is 2011-12. A search was conducted on 02.11.2017, and a satisfaction was recorded on 24.05.2021. The Department argued that the assessment year 2011-12, when calculated from the satisfaction date of 24.05.2021, falls beyond the 10-year limitation period. The CIT(A) and the ITAT relied on the Delhi High Court's decision in PCIT vs. Ojjus Medicare Pvt. Ltd. [2024] 161 taxmann.com 160 (Delhi).
What were the issues?
1. Whether the assessment for Assessment Year 2011-12 is barred by limitation, considering the satisfaction was recorded on 24.05.2021, which is beyond 10 years from the end of the assessment year. The Assessee (Revenue) contended that the assessment year 2011-12, when calculated from the satisfaction date of 24.05.2021, is beyond the 10-year limitation period, relying on the Delhi High Court's decision in PCIT vs. Ojjus Medicare Pvt. Ltd. [2024] 161 taxmann.com 160 (Delhi). The Appellant (Department) could not point to any judgment contrary to the view taken by the Delhi High Court in Ojjus Medicare. Their only submission was that the matter is pending before the Hon'ble Supreme Court via SLP, where notice has been issued.

by the Commissioner of Income Tax (Appeals) (hereinafter referred to as ‘CIT(A)), have been dismissed.
The undisputed facts of the present case are that, a search was conducted by the Department under Section 132 of the Act of 1961 in the case of Sh.Rakesh Jain Group on 02.11.2017 and a satisfaction was recorded on 24.05.2021. The Assessment Year in question is, 2011-12. The CIT(A) relied upon Ojjus Medicare (supra) and allowed the appeal preferred by the assessee which has been affirmed by the Tribunal.
Mr. Vipul Agrawal, learned senior standing counsel for the appellant-Department, could not point out any judgment contrary to the view which has been taken by the Delhi High Court.
