What did the High Court hold?

The High Court set aside the impugned orders of the Commissioner of Income Tax (Appeals) and the Income Tax Appellate Tribunal. The Court noted that the Commissioner and the Tribunal had not provided a finding on whether the Area Development Fund was utilized for its intended purpose. The Court referred to the Supreme Court's decision in Siddheshwar Sahakari Sakhar Karkhana Ltd. Vs. Commissioner of Income Tax, which highlighted that the Area Development Fund is meant for socio-economic services in the area of operation, with resolutions passed by the Board of Directors, sanction from the Director of Sugars, and approval from the General Body. The Supreme Court also observed that the fund is retained by the sugar factory and utilized as per government guidelines. The High Court found that the Tribunal and the Commissioner failed to consider the relevant aspects as observed by the Apex Court. Consequently, the matter was remanded back to the Commissioner (Appeals) for a fresh decision after hearing the parties and considering the Siddheshwar S.S.K. Ltd. case. The parties were directed to appear before the Commissioner on April 4, 2018.

What were the facts?

These appeals by three cooperative sugar factories – The Kopargaon Sahakari Sakhar Karkhana Ltd., Mula Sahakari Sakhar Karkhana, and Sangamner Bhag Sahakari Sakhar Karkhana Ltd. – challenge orders from the Commissioner of Income Tax (Appeals) and the Income Tax Appellate Tribunal. The core issue revolves around the tax treatment of amounts collected by the factories for an Area Development Fund. The Assessees are the cooperative sugar factories, and the Revenue is represented by the Deputy Commissioner of Income Tax and the Commissioner of Income Tax (Appeals). The assessment years are not explicitly stated but are implied to be those for which the impugned orders were passed. The procedural history involves appeals being filed before the High Court after decisions by the lower appellate authority and the Tribunal.

What were the issues?

1. Whether the amounts collected by the assessee cooperative sugar factories towards the Area Development Fund constitute income taxable under the Income Tax Act, 1961, or if they represent a diversion of income at source or are impressed with a specific legal obligation to be spent for purposes unrelated to the business of the sugar factory. Assessee's Contention: The assessee argued that the Area Development Fund collections are not their income. They contended that these amounts are impressed with a specific legal obligation to be spent for purposes unrelated to the sugar factory's business, drawing an analogy to collections for charity or deposits. They relied on the Supreme Court's observation in CIT Vs. Bijlee Cotton Mills. Revenue's Contention: The revenue's position, as reflected in the lower authorities' decisions, appears to be that these funds are taxable income. The judgment mentions that the Tribunal and the Commissioner did not give a finding that the fund was not utilized for its intended purpose, implying the dispute was not on utilization but on the nature of the receipt itself.

Which sections of the Income-tax Act were involved?

Section 79-A of the Maharashtra State Cooperative Societies Act

ORAL JUDGMENT (Per S.V. Gangapurwala, J.) 1. ors., reported in JT 2004 (7) SC 295 has observed thus:

“57. The Area Development Fund, as we see from the various communications placed in the paper-book, is meant to enable the co-operative sugar factories to render socio- economic services in the area of operation. The area development programmes may cover agricultural extension, irrigation facilities, educational and medical services, development of animal husbandry and poultry, drought relief work and so on. By doing so, the sugar cooperatives will be supplementing the efforts of the Government in promoting the socio-economic development of the area. The Board of Directors of the cooperative society are required to pass a resolution specifying the details of expenditure proposed to be incurred from out of the Area Development Fund. They should obtain the sanction of the Director of Sugars for incurring such expenditure. Such information is also required to be placed before the General Body of the society and the approval to be obtained from the General Body. On 21st June, 1988, the Agriculture and Co- operation department of the Government of Maharashtra framed certain directive principles laying down the modalities of utilization of Area Development Funds. The said order was issued in exercise of the power under Section 79-A of the Maharashtra State Cooperative Societies Act. This order passed during the middle of the last assessment year relevant to these appeals gives statutory basis for the already existing practice. It is difficult to equate this fund to the other categories of funds, as has been done by the Tribunal and affirmed by the High Court. Unlike the other funds like Chief Minister's Mills [(1979) 1161 TR60 (SC)], has been invoked to vvr
