M/S ROULUNDS CONDAN INDIA LTD. vs. DY.COMMISSIONER OF INCOME TAX
What did the High Court hold?
The High Court noted that the petitioner had filed a writ petition seeking to quash certain income tax orders and to direct the respondent to stay recovery proceedings for interest under Section 220(2). The court was informed that the petitioner had previously appealed against an assessment order that included an addition of Rs. 1 crore as capital expenditure. This addition was initially partly allowed by the CIT(A), but restored by the ITAT. Crucially, the petitioner's appeal to the High Court under Section 260A was allowed vide order dated 20.04.2018. Subsequently, the Assistant Commissioner of Income Tax gave effect to this appellate order, making a refund to the petitioner. In light of these developments, the High Court found that nothing remained to be adjudicated in the present writ petition. Therefore, the writ petition was dismissed as infructuous.
What were the facts?
The petitioner, M/s Roulunds Condan India Ltd., filed a writ petition challenging an Income Tax Computation (ITNS 150) dated 17.05.2005 and an order dated 17.05.2025 passed under Section 254 by the respondent (Dy. Commissioner of Income Tax). The petitioner also challenged a letter dated 15.07.2005 and sought a stay on recovery of outstanding demand of Rs. 53,89,122/- representing interest under Section 220(2) of the Income Tax Act, 1961. The core dispute stemmed from an addition of Rs. 1 crore as capital expenditure in the petitioner's assessed income via an Assessment Order dated 17.03.1999 under Section 143(3). The petitioner's appeal before the CIT(A) was partly allowed. The ITAT, in an appeal by the Department, restored the addition of Rs. 1 crore. The petitioner's subsequent appeal to the High Court under Section 260A was allowed on 20.04.2018.
What were the issues?
1. Whether the Income Tax Computation (ITNS 150) dated 17.05.2005 and the order dated 17.05.2025 passed under Section 254, along with the letter dated 15.07.2005, are liable to be quashed. (Question of law and fact) 2. Whether the respondent should be directed to stay the proceedings for recovery of outstanding demand of Rs. 53,89,122/- representing interest under Section 220(2) and to recompute the demand without levying such interest. (Question of law and fact) The petitioner argued that the addition of Rs. 1 crore as capital expenditure was the basis of the dispute. The revenue's contentions are not explicitly recorded in the provided text, beyond the fact that the Department preferred an appeal before the ITAT. The judgment mentions that the High Court allowed the petitioner's appeal under Section 260A on 20.04.2018, which would have a bearing on the subsequent demand and interest.
