What did the Tribunal hold?

The Tribunal held that the CIT(A) had inadvertently erred in dismissing the assessee's appeal on the ground of limitation. The Tribunal noted that the Supreme Court, in its order in Suo Motu Writ Petition (C) No.3 of 2020, had directed the exclusion of the period from 15/03/2020 to 28/02/2022 for the purpose of computing limitation in all judicial or quasi-judicial proceedings. Considering this, the appeal filed by the assessee on 03/01/2022 was well within the stipulated time period. Therefore, the Tribunal set aside the order of the CIT(A) and remanded the case back to the CIT(A) with a direction to readjudicate the appeal on its specific grounds. The issue of whether the AO was justified in levying interest under section 201(1A) was not decided on merits as the appeal was remanded.

What were the facts?

The assessee, Datla Swapna (formerly Siravuri Swapna Kumari), filed an appeal before the ITAT challenging the order of the Addl/JCIT (Appeals), Faridabad. The original order under challenge was passed by the Assessing Officer (AO) under section 201(1)/(1A) of the Income Tax Act, 1961, on 30/09/2021 for Assessment Year 2017-18. The AO had raised a demand of Rs.7,71,767/- (Rs.4,98,382/- under section 201(1) and Rs.2,19,288/- under section 201(1A)) for failure to deduct tax at source on the purchase of immovable property from a non-resident. The CIT(A) dismissed the assessee's appeal in limine due to a delay of 95 days in filing the appeal, finding the explanation for the delay unsatisfactory.

What were the issues?

1. Whether the CIT(A) was justified in dismissing the appeal in limine on the ground of a 95-day delay in filing the appeal against the order passed under section 201(1)/(1A) of the Act, considering the assessee's explanation for the delay. 2. Whether the appeal filed by the assessee before the CIT(A) on 03/01/2022 was within the period of limitation, considering the Supreme Court's order in W.P. (C) No. 3 of 2020 extending the limitation period. 3. Whether the order passed by the AO under section 201(1)/(1A) of the Act was barred by limitation. 4. Whether the AO was justified in levying interest of Rs.2,19,288/- under section 201(1A) of the Act. Assessee's Contentions: - The CIT(A) erred in dismissing the appeal on limitation based on misconceived facts. - The appeal filed on 03/01/2022 was within the period of limitation due to the Supreme Court's order in Suo Motu Writ Petition (C) No.3 of 2020, which excluded the period from 15/03/2020 to 28/02/2022 for reckoning limitation. - The order passed by the AO was barred by limitation. - The AO was not justified in levying interest under section 201(1A). Revenue's Contentions: - The judgment records no specific contentions from the revenue regarding the limitation issue.

The present appeal filed by the assessee is directed against the order passed by the Addl/JCIT (Appeals), Faridabad, dated 21/01/2026, which in turn arises from the order passed by the Assessing Officer (for short “AO”) under section 201(1)/(1A) of the Income Tax Act, 1961 (for short “the Act”), dated

ITA 343/VIZ/2026 DATLA SWAPNA (FORMERLY KNOWN AS SIRAVURI SWAPNA KUMARI)

30/09/2021 for Assessment Year (AY) 2017-18. The assessee has assailed the impugned order on the following grounds of appeal:

“1. The order of learned Commissioner of Income Tax (Appeals) is contrary to the facts and also the law applicable to the facts of the case. 2. The learned Commissioner of Income Tax (Appeals) is not justified in dismissing the appeal in-limine under the erroneous belief that there was delay of 95 days in filing the appeal against the order passed on 30.09.2021 u/s 201(1)/201(1A) of the Act and that the appellant failed to explain the delay. 3. The learned Commissioner of Income Tax (Appeals) ought to have considered that there is no delay in filing the appeal as the appeal filed on 03.01.2022 was within the period of limitation as per the order of the hon'ble Supreme Court in W.P no.03 of 2020 extending the Limitation to 29.02.2022. 4. Without prejudice to the above, the learned Commissioner of Income Tax (Appeals) ought to have quashed the order passed on 30.09.2021 u/s 201(1)/201(1A) as barred by limitation. 5. Without prejudice to the above, the learned Commissioner of Income Tax (Appeals) ought to have held that the assessing officer is not justified in levying interest of Rs.2,19,288 u/s 201(1A) of the Act. 6. Any other ground that may be urged at the time of appeal hearing.”

2.

Succinctly stated, the AO based on the fact that the assessee had during the subject year purchased an immovable property admeasuring 488 sq yds at Visakhapatnam from Shri Kondepudi Narayana Sekhar (PAN: AQGPK6076Q), resident of U.S.A vide Document No.2626/2016 on 08/06/2016 registered before the SRO, Anandapuram, Visakhapatnam District for a consideration of Rs.24,45,000/-, but had failed to deduct the tax at source on the sum payable to the aforesaid non-resident seller under section 195 of the Act, raised a demand aggregating to Rs.7,7,17,670/- under section 201(1)/201(1A) of the Act, viz., (i) under section 201(1) of the Act: Rs.4,98,382/-; and (ii) under section 201(1A) of the Act: Rs.2,19,288/-.

ITA 343/VIZ/2026 DATLA SWAPNA (FORMERLY KNOWN AS SIRAVURI SWAPNA KUMARI) 3. Aggrieved, the assessee carried the matter in appeal before the CIT(A). However, the CIT(A) observing that the appeal filed by the assessee involved a delay of 95 days, therein rejected the claim raised by the assessee in Form-35 regarding the reason for the delay involved in filing the subject appeal within the stipulated time period and dismissed the appeal in limine.

4.

The assessee, aggrieved with the order of the CIT(A) has carried the matter in appeal before us.

5.

Shri GVN Hari, Advocate, Learned Authorized Representative (for short, “Ld. AR”) for the assessee, at the threshold of hearing of the appeal submitted that the CIT(A) had based on misconceived facts dismissed the assessee’s appeal on the ground of limitation. Elaborating on his contention, the Ld. AR submitted that the assessee had filed an appeal against the order of the ITO, Ward (Int. Taxn), Vizag, dated 30/09/2021 before the CIT(A) on 03/01/2022. The Ld. AR submitted that though the appeal under the normal circumstances as per the prescribed time limit ought to have been filed latest by 30/10/2021, but due to the unprecedented disruption caused by the Covid-19 pandemic, the aforesaid period for the purpose of reckoning the period of limitation, as per the order of the Hon’ble Supreme Court in Suo Motu Writ Petition (C) No.3 of 2020, dated 10/01/2022, from 15/03/2020 till 28/02/2022 stood excluded. It was further submitted by the Ld. AR that considering the aforesaid decision of the Hon’ble Supreme Court, the

ITA 343/VIZ/2026 DATLA SWAPNA (FORMERLY KNOWN AS SIRAVURI SWAPNA KUMARI) appeal filed by the assessee before the CIT(A) on 03/01/2022 was well within the prescribed time limit.

6.

Per contra, Sri A.P. Babu, Learned Senior Departmental Representative (for short, “Ld. AR”) did not controvert the aforesaid contention of the Ld. Counsel for the assessee.

7.

We have given thoughtful consideration to the contentions advanced by the Learned Authorized Representatives of both parties in the backdrop of the orders of the authorities below.

8.

Admittedly, it is a matter of fact borne from record that pursuant to the order of the Hon’ble Supreme Court in Suo Motu Writ Petition (C) No.3 of 2020, dated 10/01/2022, the period from 15/03/2020 to 28/02/2022 shall stand excluded for the purposes of limitation as per any general or special laws in respect of all judicial or quasi-judicial proceedings. In view of the same, we find substance in the Ld. AR’s contention that the CIT(A) had inadvertently erred in losing sight of the fact that considering the extended period of limitation pursuant to the judgment of the Hon’ble Supreme Court in Suo Motu Writ Petition (C) No.3 of 2020, dated 10/01/2022, the appeal filed by the assessee was well within the stipulated time period. Accordingly, we hereby set aside the order passed by the CIT(A) to his file with a direction to readjudicate the case on the specific grounds of appeal based on which the impugned order of assessment has been assailed before him.
