AI SummaryDismissed

What did the Tribunal hold?

The Tribunal held that the assessee is not entitled to immunity from penalty under section 270AA of the Income Tax Act, 1961. The Tribunal observed that the penalty was levied by the Assessing Officer under section 270A(9) of the Act, which deals with cases of under-reporting of income in consequence of misreporting of income. The Tribunal referred to the provisions of section 270AA(3), which explicitly states that immunity from penalty under section 270A is not available where the proceedings for penalty have been initiated under the circumstances referred to in sub-section (9) of section 270A. The Tribunal found that the assessee had falsely claimed deductions under Chapter VI-A without producing any documentary evidence, and the AO had disallowed these claims due to the non-availability of evidence. Therefore, the penalty levied under section 270A(9) was upheld, and the issue raised by the assessee was dismissed. The appeal filed by the assessee was accordingly dismissed.

What were the facts?

The assessee, Mohammed Armanulla, filed an appeal before the ITAT Bangalore Bench against the order of the CIT(A) for Assessment Year 2023-24. The assessee initially filed a return of income declaring Rs. 47,17,380, which was later revised to Rs. 46,65,910. The Assessing Officer (AO) completed the assessment under section 143(3) r.w.s. 144B, determining the assessed income at Rs. 77,32,367 by making additions of Rs. 30,66,457 on account of various deductions and exemptions claimed. Subsequently, the AO initiated penalty proceedings under section 270A for under-reporting and misreporting of income and levied a penalty of Rs. 19,13,471. The assessee's appeal before the CIT(A) was dismissed due to a delay of 2 days. The assessee then filed an appeal before the ITAT.

What were the issues?

1. Whether the assessee is entitled to immunity from penalty under section 270AA of the Income Tax Act, 1961, when the penalty was levied under section 270A(9) of the Act. (Question of law) The assessee argued that they had paid the demand, had not filed an appeal against the quantum assessment before the CIT(A), and had filed Form 68 under section 270AA(2) seeking immunity from penalty, and therefore, the penalty should be deleted. The revenue contended that the penalty was levied under section 270A(9) of the Act, making immunity proceedings inapplicable. They also submitted that the assessee had wrongly claimed deductions under Chapter VI-A of the Act, and therefore, the penalty should be sustained.

Pronounced: 14.10.2026

आदेश / ORDER

PER BALAKRISHNAN S, ACCOUNTANT MEMBER:

This appeal is filed by the assessee against the order of Ld. Commissioner of Income-tax (Appeals), NFAC (Ld CIT(A)) vide DIN: ITBA/NFAC/S/250/2025-26/1085898659(1) dated 11-Feb-2026 for the Assessment Year 2023-24 arising out of the Order passed udner section 270A of the Act, dated 29.05.2025.

2.

Briefly stated the facts of the case are the assessee, an individual, filed his return of income for the AY 2023-24 on 03.07.2023 declaring total income of Rs. 47,17,380/- after claiming deductions under various heads. However, the assessee revised his ITR on 11.09.2023 declaring a total income of Rs. 46,65,910/- claiming deductions u/s 80C,80D,80E,80GGC of the IT Act amounting to Rs.16,05,000/- which was restricted to Rs.15,25,000/-. The case was selected for scrutiny under CASS. Notice u/s 143(2) dt 19.06.2024 was issued and served on the assessee. Thereafter notices u/s 142(1) of the Act was issued on various dates. The learned Assessing Officer (Ld AO) in the absence of documentary evidences completed the assessment proceedings for A.Y. 2023-24 u/s 143(3) r.w.s. 144B of the Act on 25/11/2024. The assessed income was determined at Rs. 77,32,367/- by addition of Rs. 30,66,457/- on account of LTA of Rs. 31,574/-, Deduction u/s 80E of Rs. 3,00,000/- /- Deduction u/s 80GGC of Rs. 10,00,000/-, HRA exemption Rs.16,59,883/-, Deduction u/s 80D Rs.75,000/-. Thereafter the Ld AO initiated penalty proceedings u/s 270A of the Act for under reporting of the income in consequence of misreporting of income. The Ld AO observed that since the Penalty proceedings was initiated u/s 270A as “under reported his income in consequence of misreporting of income” immunity is not applicable in this case. He therefore levied a penalty of Rs.19,13,471/- u/s 270A(9) of the Act.

3.

On being aggrieved by the order of the Ld AO the assessee filed an appeal before the Ld CIT(A) with a delay of 2 days. The Ld CIT(A) considering the failure by the assessee to establish any reasonable cause for the inordinate delay, dismissed the appeal.

4.

On being aggrieved by the order of the Ld CIT(A) the assessee filed an appeal before the Tribunal by raising 9 grounds. The core issue emanating from the grounds is with respect levying of the penalty which was sustained by Ld CIT(A).

5.

The learned Authorised Representative (Ld AR) submitted that the assessee has paid the demand in installments and has also not filed an appeal before the Ld CIT(A) against the quantum appeal and therefore entitled for immunity. He also submitted that that the assessee has filed Form 68 on 10.04.2025 u/s 270AA(2) of the Act, seeking immunity from the penalty. He therefore prayed that penalty be deleted.

6.

Per Contra the learned Departmental Representative (ld DR) submitted that penalty was levied under section 270A(9) of the Act and hence immunity proceedings are not applicable. He also submitted that the assessee has claimed the deductions wrongly under Chapter VIA of the Act. He therefore prayed that the penalty be sustained.

7.

We have heard the rival contentions and perused material available on record. It is an undisputed and admitted fact that the assessee falsely claimed deduction under Chapter VIA of the Act, The assessee could not produce any documentary evidences with respect to the deduction claimed in the return of income either before Revenue or before us. The Ld AO therefore disallowed the claim made by the assessee considering the non availability of evidences. Moreover we notice that the penalty proceedings has been initiated under section 270A(9) of the Act which is not covered under immunity proceedings prescribed u/s 270AA of the Act. We extract below the provisions of section 270AA which reads as follows:

Immunity from imposition of penalty, etc. 270AA. (1) An assessee may make an application to the Assessing Officer to grant immunity from imposition of penalty under section 270A and initiation of proceedings under section 276C or section 276CC, if he fulfils the following conditions, namely:— (a) the tax and interest payable as per the order of assessment or reassessment under sub-section (3) of section 143 or section 147, as the case may be, has been paid within the period specified in such notice of demand; and (b) no appeal against the order referred to in clause (a) has been filed. (2) An application referred to in sub-section (1) shall be made within one month from the end of the month in which the order referred to in clause (a) of sub- section (1) has been received and shall be made in such form and verified in such manner as may be prescribed. (3) The Assessing Officer shall, subject to fulfilment of the conditions specified in sub-section (1) and after the expiry of the period of filing the appeal as specified in clause (b) of sub-section (2) of section 249, grant immunity from imposition of penalty under section 270A and initiation of proceedings under 276C, where the proceedings for penalty under section 270A has not been initiated under the circumstances referred to in sub-section (9) of the said section 270A.

8.

On a plain reading of the above section we are of the view the immunity proceedings are permissible only when the penalty is levied under circumstances listed u/s 270A(2) of the Act and not when the penalty was levied under section 270A(9) of the Act.

9.

In the instant case the Ld AO levied penalty under the circumstances mentioned in 270A(9) of the Act. We have therefore no hesitation to uphold the penalty order of the Ld AO. Accordingly, the issue raised by the assessee is dismissed.

10.

In the result, appeal filed by the assessee is dismissed.
