What did the Tribunal hold?

The Tribunal condoned the delay of 70 days in filing the appeal, relying on the judgments of the Hon'ble Supreme Court in Collector, Land Acquisition, Anantnag & Anr. Vs. Mst. Katiji & Ors. and Inder Singh Vs. State of Madhya Pradesh. The Tribunal noted that the assessee is a senior citizen and a retired government employee and found the delay to be for a 'reasonable cause', neither deliberate nor intentional. Furthermore, in the interest of justice, the Tribunal set aside the impugned ex-parte order dated 12.01.2026 and restored the issues to the file of the CIT(A) for necessary adjudication as contemplated under Section 250(6) of the Act, after affording a reasonable opportunity to the assessee. The assessee was directed to provide updated contact details and remain vigilant. The effective grounds of appeal were allowed for statistical purposes.

What were the facts?

The assessee, Chandrajyoti Arun Muley, filed an appeal before the ITAT Pune against an order dated 12.01.2026 passed by the NFAC, Delhi, which arose from an assessment order dated 20.03.2025 passed under Section 147 of the Income Tax Act, 1961, for Assessment Year 2021-22. The appeal was filed with a delay of 70 days. The assessment order was passed after a search in the case of Manojkumar Jamnadas Ladani and Krrish Group, which revealed information about the assessee allegedly paying on-money of Rs. 1,22,460/- to a builder. Notices under Section 148 and 142(1) were issued, but the assessee did not comply. The Assessing Officer made an addition of Rs. 1,22,460/-, assessing the income at Rs. 11,02,600/-. The assessee's earlier appeal before the CIT(A) was dismissed for non-prosecution.

What were the issues?

1. Whether the delay of 70 days in filing the appeal before the Tribunal should be condoned, considering the assessee is a senior citizen and retired government employee. Assessee's contentions: The assessee argued that the delay was due to reasons beyond their control and sought condonation based on the affidavit filed. They also contended that the addition was based on third-party information (pen drive) without providing a copy of the material or an opportunity for cross-examination, thus violating principles of natural justice. They prayed for the matter to be set aside to the CIT(A) for adjudication. Revenue's contentions: The learned DR raised no objection to the request made by the learned counsel for the assessee.
