KAUSHALAM FOUNDATION,AJMER ROAD vs. CIT-EXEMPTION JAIPUR , JAIPUR
In favour of the assessee: the assessee's appeal was allowed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that the Ld. CIT(E) had erred in cancelling the application for registration under Section 80G(5). The primary reasoning was that the CIT(E) had subsequently granted registration to the assessee under Section 12AB of the Income Tax Act, 1961, by an order dated September 27, 2026. The Tribunal found that all objections raised by the CIT(E) while rejecting the Section 80G application had become infructuous, as they had already been addressed and decided in favor of the assessee during the Section 12AB registration process. Since approval under Section 80G is consequential to registration under Section 12AB, and the latter had been granted, the Tribunal allowed the appeal. The operative direction was for the Ld. CIT(E) to issue the approval under Section 80G in accordance with the law. No issues were expressly left undecided.
What were the facts?
The assessee, Kaushalam Foundation, filed an appeal before the Income Tax Appellate Tribunal (ITAT), Jaipur Bench, challenging an order dated January 13, 2026, passed by the Commissioner of Income Tax (Exemption) [CIT(E)], Jaipur. The CIT(E) had cancelled the assessee's application for permanent registration under Section 80G(5) of the Income Tax Act, 1961. The assessee's application in Form No. 10AB, seeking approval under Section 80G(5)(iv)(B), was rejected by the CIT(E) on grounds of an incomplete Form 10AB, non-registration under the Rajasthan Public Trust Act, 1959, and non-genuineness of activities and non-compliance. The appeal was filed for the assessment year not specified in the judgment.
What were the issues?
1. Whether the Ld. CIT(E), Jaipur, erred in facts and law by cancelling the application for permanent registration under Section 80G(5) of the Income Tax Act, 1961. Assessee's Contention: The assessee argued that the grounds for rejecting the Section 80G(5) application had become infructuous. This was because the CIT(E) had subsequently passed an order dated September 27, 2026, granting registration under Section 12AB of the Act. The assessee contended that approval under Section 80G is consequential to registration under Section 12AB. Revenue's Contention: The judgment records that the Ld. DR for the Revenue was heard, but their specific contentions are not detailed.
