SMT. BHARTI PATNI vs. THE INCOME TAX APPELLATE TRIBUNAL
What did the High Court hold?
The High Court acknowledged the petitioner's grievance that the non-functional ITAT Bench was hindering her right to challenge the proceedings initiated under Section 263. Recognizing that the Jabalpur Bench had become partially functional, the Court directed the respondents (presumably the revenue authorities) to place the petitioner's appeal before the ITAT Bench as and when it becomes available for sitting at Jabalpur. The Court further ordered that no assessment proceedings under Section 143(2) shall be held until the ITAT decides the petitioner's appeal. The assessment proceedings pursuant to the Section 263 order are to be undertaken only after the ITAT's decision. The writ petition was disposed of with these directions.
What were the facts?
The petitioner, Smt. Bharti Patni, challenged an order passed under Section 263 of the Income Tax Act for assessment year 2009-2010. She had filed a regular appeal before the Income Tax Appellate Tribunal (ITAT), Jabalpur Bench. However, due to the ITAT Jabalpur Bench not being functional, and the revenue proceeding with assessment under Section 143(2), the petitioner filed a writ petition. The High Court took cognizance, stayed the assessment proceedings, and noted that the Jabalpur Bench had become partially functional with circuit sittings. The Court directed the respondents to place the matter before the Bench when available for a decision in accordance with law.
What were the issues?
1. Whether the assessment proceedings under Section 143(2) can continue while the petitioner's appeal against the Section 263 order is pending before a non-functional ITAT Bench, thereby impeding the petitioner's right to challenge the proceedings. Assessee's contention: The petitioner argued that the non-functionality of the ITAT Jabalpur Bench prevented her from challenging the Section 263 order, and the ongoing assessment proceedings under Section 143(2) were unsustainable in this context. The petitioner invoked writ jurisdiction due to the absence of a forum to challenge the proceedings. Revenue's contention: The judgment does not record any specific contentions made by the revenue regarding the issues raised by the petitioner.
