WP-16778-2014 (PANDIT DWARKA PRASAD MISHRA Vs INCOME TAX DEPARTMENT) 24-04-2015 Shri A.P.Singh, learned counsel for petitioner. Shri G.N.Purohit, learned Sr. Counsel with Shri Sanjay Lal, Advocate for respondents. Considering the fact that an appeal which was pending before the appellate authority has now been decided during pendency of the matter. The petitioner is now required to challenge the order passed in appeal in accordance with statutory provision as applicable under the Income Tax Act and therefore this petition which was filed claiming interim relief during the pendency of the appeal has become infructuous. Granting liberty to the petitioner to challenge the order passed in appeal in accordance with the statutory provisions before the competent authority of the department, we disposed off this writ petition. C.C. as per rules. (RAJENDRA MENON) JUDGE (MOOL CHAND GARG) JUDGE
