Shri R.L. Jain, learned Senior Counsel with Ms. Veena Mandlik, learned counsel for the appellant. At the outset, it has been stated by the learned Senior Counsel for the appellant that the question involved in this income tax appeal has already been answered against the Revenue by a Division Bench of this Court in the case of J.P. Tobacco Products Private Limited v. Commissioner of Income Tax [1998] 229 123 and the order passed by the Division Bench has attained finality, in view of the dismissal of the SLP by the Supreme Court.
