The Principal Commissioner Of Income Tax Ii vs. M/S Suraj Impex Pvt. Ltd.
What did the High Court hold?
The High Court allowed the prayer for withdrawal of the appeal made by the appellant (Revenue). Consequently, the appeal was dismissed as withdrawn. However, the Court explicitly stated that the question of law is left open. This implies that while the appeal was disposed of on procedural grounds (withdrawal), the underlying legal issue was not adjudicated upon by the High Court. The reasoning for withdrawal was based on the appellant's counsel's submission that the appeal was covered under the departmental circulars, leading to the decision to withdraw rather than proceed with the merits.
What were the facts?
The Principal Commissioner of Income Tax, Indore, filed an appeal under Section 260A of the Income Tax Act, 1961, before the High Court of Madhya Pradesh, Bench at Indore, against an order passed by the Income Tax Appellate Tribunal. The appeal was filed against M/s. Suraj Impex Pvt Ltd. The judgment discusses various circulars issued by the Central Board of Direct Taxes (CBDT) regarding monetary limits for filing appeals before High Courts and the Supreme Court, and exceptions where appeals should be contested on merits regardless of tax effect. The appellant's counsel ultimately prayed for the withdrawal of the present appeal.
What were the issues?
1. Whether the present appeal, filed by the Revenue, is maintainable before this Court in light of the CBDT circulars regarding monetary limits for filing appeals, and if not, whether it falls under any of the exceptions allowing it to be contested on merits? Assessee's Contention: The judgment does not record any specific contentions made by the assessee. The appeal was withdrawn by the appellant (Revenue).
