The Assistant Commissioner Of Income Tax (Exemption), Bhopal, vs. Barkatullah Vishwavidyalaya
What did the High Court hold?
The High Court found no substantial question of law involved in the appeal. The Tribunal had remanded the matter to the Assessing Officer to adjudicate afresh, allowing the benefit of exemption under Section 11/12 to the assessee. The Court noted that the AO, CIT(A), and ITAT had concurrently held the respondent ineligible for exemption under Section 10(23C)(iiiab). However, the AO had not considered the applicability of Section 11/12. The respondent had been granted registration under Section 12A from 2021 to 2023, and the ITAT relied on its own decision in 'M.P. Raj Open School, Bhopal vs. Deputy Commissioner of Income-tax, Bhopal' and a CBDT Instruction, holding that the assessee is entitled to exemption under Section 11/12. The matter was remanded to the AO to provide an opportunity for the assessee to furnish necessary information for computing exemption under Section 11/12. The Court dismissed the appeal.
What were the facts?
The Assistant Commissioner of Income Tax (Exemption), Bhopal, has appealed against an order of the Income Tax Appellate Tribunal (ITAT), Indore Bench, concerning Assessment Year 2011-2012. The respondent, Barkatullah Vishwavidyalaya, a university, filed a return declaring zero income, claiming exemption under Section 10(23C)(iiiab) of the Income Tax Act, 1961. The case was reopened under Section 147. The Assessing Officer (AO) denied exemption under Section 10(23C)(iiiab), treating a surplus of Rs. 21,12,38,098/- as taxable income, assessing total income at Rs. 23,50,49,272/-. The CIT(A) partly allowed the appeal, reducing the surplus to Rs. 46,63,638/-. The ITAT, by a common order, remanded the matters to the AO to adjudicate afresh, allowing the benefit of exemption under Section 11/12.
What were the issues?
1. Whether the Tribunal erred in allowing the benefit of exemption under Section 11/12 of the Income Tax Act, 1961, for Assessment Year 2011-12, when registration under Section 12A(1)(aa) was granted only on 17.06.2019 for Assessment Year 2019-20 onwards, and the assessment for AY 2011-12 was completed on 26.11.2018 under Section 143(3) read with Section 147. Assessee's Contention (implied from ITAT's decision and subsequent paragraphs): The assessee is entitled to exemption under Section 11/12, and the registration granted for subsequent years should be considered retrospectively or that the AO failed to consider the applicability of Section 11/12. Reliance is placed on ITAT decisions and CBDT instructions. Revenue's Contention: The Tribunal erred in agreeing that the assessee is entitled to exemption under Section 11/12 for AY 2011-12, given that the registration under Section 12A(1)(aa) was granted for AY 2019-20 onwards, and the assessment for AY 2011-12 was already completed. The subsequent registration cannot reopen a completed assessment.
Which sections of the Income-tax Act were involved?
Section 260A,Section 147,Section 148,Section 143(2),Section 142(1),Section 10(22),Section 271(1)(c),Section 11,Section 12,Section 12A(2),Section 12A(1)(aa),Section 12AA

The fund received from the Government must be a direct grant/contribution from the Governmental sources and not the fee collected from the students; therefore, the assessee-University is not found eligible for exemption under Section 10(23C) (iiiab) of the Act and the surplus shown Rs.21,12,38,098 /- is treated as regular income of the assesse vide assessment 2 ITA-36-2025 NEUTRAL CITATION NO. 2026:MPHC-JBP:1135 Signed by: SHIVANI TIWARI Signing time: 1/13/2026 2:36:11 PM Signature Not Verified

is before this Court. Submissions made by learned counsel for the appellant. 6. Shri Siddharth Sharma, learned counsel for the appellant/Revenue submits that learned Income Tax Appellate Tribunal, Indore Bench, Indore has erred in agreeing to the proposition that the assessee is entitled for the benefit of exemption under Section 11/12 of the Income Tax Act, 1961 as per the requirement prescribed in proviso to Section 12A(2) of the Act for Assessment year 2011-12 whereas the registration under Section 12A(1)(aa) was granted vide order dated 17.06.2019 for the assessment year 2019-20. The Assessment of the year 2011-12, under Section 143(3) read with Section 147 had already been completed on 26.11.2018, which cannot be reopened due to the subsequent registration under Section 12A(1)(aa) read with Section 12AA granted subsequently in the year 2019. 7. We are not impressed with the aforesaid submission advanced by Shri Siddharth Sharma, learned counsel for the appellant, because ITAT, Indore has already decided this issue in the case of "M.P. Raj Open School, Bhopal vs. Deputy Commissioner of Income-tax, Bhopal" reported in (2013) 141 ITD 721. 8. The learned A.O., Commissioner of Income Tax Appeal and ITAT, all have concurrently held that the respondent is not eligible for exemption under Section 10(23C) (iiiab) of the Income Tax Act, 1961. The Assessment Officer has not considered the applicability of Section 11/12 of the Income Tax Act, 1961 for granting the benefit of exemptions. The respondent has already been granted registration under Section 12A from the 4 ITA-36-2025 NEUTRAL CITATION NO. 2026:MPHC-JBP:1135 Signed by: SHIVANI TIWARI Signing time: 1/13/2026 2:36:11 PM Signature Not Verified
(VIVEK RUSIA) JUDGE (PRADEEP MITTAL) JUDGE year 2021 till the year 2023. Without considering such registration, the A.O. completed the assessment under Section 143(3) read with Section 147 for the assessment year 2011-12. The ITAT, Indore Bench in ITA No.924/Ind/2018 had already decided the alternative claim of assessees for the grant of exemption under Section 11/12 for the assessment year 2019-20 onwards. Vide order dated 17.06.2019 issued by Commissioner of Income Tax (Exemption), Bhopal, the assessee has been held entitled to the exemption under Section 11/12 of the Act for the preceding years also. 9. The learned ITAT has relied on the view taken by "ITAT, New Delhi Conference of Religious India vs. Ward-Exemption 1(3), New Delhi" and the CBDT Instruction No. F.No.173/193/2019-ITA-I that the respondent- assessee is entitled under Section 11/12 and remanded the matter back to the A.O. by giving an opportunity to the assessee to provide necessary information for the computation of the exemption under Section 11/12 of the Act. 10. Hence, we do not find any question of law involved in this appeal and the same is dismissed accordingly. Shivani
